I've been waiting on the enforcement end of two fed laws to become better
focused. It seems that just reporting trolls for TOS violations (and this
one has already threatened to send contract killers) does not see much
happening. And Giganews is only a little better then Comcast.

This user has communicated a threat and is in violation of state and federal
laws.
Below please find the source and header information of a post that arrived
in our newsgroup. We have been innundated by this very abusive troll, who
moved to us in order to attack me after he drove everybody out of a home
recording newsgroup, where he was engaged in attacking a fellow named Mike
Rieves.
People in alt.social-security-disability are trying to conduct themselves as
appropiately as possible and share information to folks going through a very
traumatic period in their lives. We already have one troll, who has been,
for the most part, less abusive or disruptive lately. W. Gary Sokolitch has
a history of being disruptive and inconsiderate of the TOS and others.
Please see to this matter and put an end to his dysfunctional behaviors.

This is actually true. This forum is protected by the 1st Amendment.
However, threats are not. You can tell someone they are a dumbshit all
day long. You just can't make a threat that would inflict harm onto
someone, and that harm is not neccessarily physical, as this forum has
a lot of mentally ill people, and making a threat to one of them, say,
is a felony if it can be proved the treat harmed the person mentally.
Harm to disabled individuals is a felony unlike a simple battery
charge or whatever. So if you come here, threaten someone with PTSD or
paranoid-schizophrenia or bi-polar and GAD or whatever directly, it's
actionable and a felony charge. Just as mistreatment of the elderly is
a felony. Now if you come here and say "You are all nuts" or "living
off the puclic teet" or whatever, it's protected.

If someone violates the TOS they violated it. What happens next is

my ISP's, one is a paid service and on is not. Now, if I access AOL
via Comcast, the protection goes out the window. How you can access
AOL without say Comcast or Roadrunner or whatever is beyond me but if
you can, it's protected. Once a dollar is paid, it is not.

True, but that has nothing to do with it being privately owned. 1st
Amendment protection of speech protects from *government* restrictions
on said speech. No one has a constitutional right to use a *privately
owned* service. That privilege can only be granted by the owners of
said services, in conjunction with their ToS.

No, it isn't. The First Amendment only restricts governmental action. A
Usenet service or an ISP can cancel a customer's service for any reason
or none at all, as long as the cancellation is not discriminatory

Well, you know, there are those who realize they're mentally ill, claim
