Lump Sum Backpayment Question

I am posting this question on behalf of my wife who was just recently
awarded SSDI. I know that the attorney receives his/her pay for the
services that he/she performed while representing a client. My wife's
attorney sent her a letter saying that she had received her payment on
November 6. How long after the attorney receives her pay will my wife
receive her lump sum backpayment?

It's difficult to narrow it down.
Because it's one of those "'round toit" tasks. It could show up in a week or
two OR it could take them three months to process the check.
Best thing to do is keep reminding yourself that now is not the time to
start holding your breath. :)

Would be nice if someone at the SSA would get round to it. It
certainly won't be a week. That's been gone already. I guess she'll
just have to check the bank account balance online each day from what
I have read in past postings. Thank you Stu.

BTW, do they have the houses all lit up yet on 34th Street? It sure is
a wonderful sight, but I'd hate to have their BGE bill!

I don't know. Haven't been there in years. I seem to remember it in it's
infancy. From what I've read since leaving, it's a super cool way to lite up
a street and the city has joined the neighborhood association with access to
better power source and supply.
That's a big relief to those homeowners who used to foot 100% of the bill.

Seriously, it took me several months between the time SSA told me
I was approved and I saw my lump sum. I had no attorney however.

Depends how busy the payment office is and how many people
are working there.

Money may arrive a bit ahead or after the "we sent you
money" notification letter--no way to know.

This is what I experienced (generally).

Expect a letter telling you how much the TOTAL backpay will
be--so you can keep track of how much you actually receive.
Keep all letters and notifications. You should get a letter
telling you how much they paid to your lawyer, plus letters
telling you if they paid anyone else (such as state aid
being repaid, etc)--and if so, how much.

Generally, first payment to you within 90-120 days (can be
longer if payment office backed up). You will get a letter
and it will tell you how much you got (will get) and
describe any deductions (if any--back taxes, any
overpayments deducted, etc).

Then another payment at about 180 days--with another letter.

Balance at one year--final letter.

Talk to your bank about setting up electronic deposit, and
you don't have to worry about it being "in the bank". The
money is just there on the correct day every month.

Remember Medicare Parts B and D. B starts two years after
payments were supposed to start, so that is some $96.xx per
month they will deduct (for B) if she gets it.

Thank you Gerald. My wife was appoved for SSDI benefits in July. She
received the letter telling her how much she would receive each month
and has been receiving the payments each moonth since then. Direct
deposit has already been set up. She is on Medicare and selected AARP
for her health care provider. All of that is going well.

The problem is the attorney who respresented my wife received her pay,
but it was for the wrong amount. She had to return the payment and
finally got the correct payment on November 6. Now that the attorney
has received her payment, the question is how long before my wife
receives her backpay? Being that the payment may arrive before the
letter does, I guess the best thing is to check the bank account each
business day to see if perhaps the backpay has been deposited before
the letter arrives?

Could that be the 5 month waiting period? That's what happened with
me. I was notified in April and received in in September

I recall now that I did get the money before the letter came
saying I would, but I was notified by telephone well ahead of that.

Approved in July--but when is the disability date set by SS?
That is the key. This date was more than two years ago (due
to her being on Medicare now). SS pays the lawyers
immediately once the total backpay is known. Eventually you
will get the letters telling you everything. The chokepoint
(as I understand it) is the payment office--figuring out how
much goes to reimburse SSI (if any), state offices (General
Assistance), and other govt agencies that gave you "loans"
while your SSDI application was in process. SS pays all of
them (such as the lawyer) out of your backpay FIRST--and you
get what is left over. So, you see why it takes a while.
They have to get the "you owe $XXX" to "govt agency YYY"
(where XXX could be zero, but they have to have the
paperwork from each govt agency to prove it is zero--or some
other number....). Govt agency YYY could be IRS (back
taxes), back child support owed, etc. So, they check--and
that takes time. THEN they pay you.

through the SSDI process. But my medical plan was not all that great.
The copays for things like CT scans, MRIs, colonoscopies, specialists,
etc. really added up and we put those on credit cards. Due to the
economic crisis, I lost my full time job that I had at the time and
now work a part-time job and I'm lucky to have gotten that. We did not
receive any government support at any time. There are no child support
issues. We don't owe the IRS. We just want to get these credit cards
paid off to give us more money to live off of.

Another question....is there going to be a COLA increase for 2010 for
SSDI recipients?

Good question Relayer, I don't t think that's how it works tho. I
was approved 6/17, and had the money before 10/31. And it took almost
2 years from the time I was disabled til I got the lump sum. The 5
month waiting period was history by then.

No COLA in 2010. GWB's Great Recession clobbered the economy
in general in 2009 (as you know). Neither SS nor Medicare
will go up in January. Medicare Part D WILL change/go
up--but that is not the govt (it is private insurance).

June 2006 is month of disability, so that is the start of
the 5-month waiting period. Backpay starts Nov or Dec 2006.
Essentially all of 2007, 2008, plus about half of 2009--or
about 30-33 months of backpay. Do the math deducting 5.8%
for 2008 and another 2.5% for 2007. Rough ballpark numbers.

You may not have owed the IRS or others, but the SS payment
office still has to have the official paperwork from the
other bureaucracies to prove it. But, if you got approved
this past summer, then you should be seeing the first money
"real soon now". I called the national toll-free number for
SS and started bugging them about where is the money. They
have an internal system for communication--and they might
just tell you it is at the payment office (which is exactly
what happened to me). No way to reach them at the payment
office....

Well almost correct-the Medicare part B monthly premium is going up but only
for those new to part B.
The Part B monthly premium increases 15% to $110 monthly per new
participants vs current $96.40
Most Medicare beneficiaries will not see a Part B monthly premium increase
as a result of a "hold harmless" provision in the current law.

Sound legitimate to me. If you have direct deposit it may very well
arrive much sooner. I do believe(best of my recollection) when I was
told something similar that the money was released just about 8-10 days
later.

Sure thing, good luck with it all and you seemingly already understand
don't spend it until it's in your hand. With Social Security
nothing is guaranteed before then. But it does sound very
