The Absolute Latest on My Coup at CKLN

2000 to Feb.22, 2009), writes:
[This is a long delayed update on the legal case going through Ontario
Superior Court with regard to an Application served by Mary Young on
CKLN Radio Inc. back in late October, 2009.
In case you're unfamiliar with what's going on, here is a brief
synopsis:
Mary Young, along with another person, was elected for a one year term
as a community representative Director to the CKLN Board at the
company's AGM in November 2008.
By March, CKLN was paralyzed and effectively shut down in part due to
the Ryerson Students' Union (RSU) decision to unilaterally cut off
funds to the station months earlier.
In July 2009, a group of individuals, claiming some authority or
other, organized a meeting in a location controlled by the RSU, had
what they called an "election" and eventually laid claim to CKLN Radio
Inc. The Application states that this action was illegal, violated
CKLN's bylaws in a variety of ways, was part of a long history of
mismanagement and therefore CKLN's operations need to be "regularized"
by order of the courts.
Unlike a regular lawsuit, this Application is going through the
Commercial Court and is moving quickly.
Mary Young and Greg Duffell have supplied Affidavits. The Young
Affidavit is more general in nature and covers the history of events
at CKLN from the time she was elected to the present. The Duffell
Affidavit is more focused on events concerning the July 24, 2009 and
October 28, 2009 meetings and current happenings.
Andrew Lehrer, one of those "elected" at the July 24, 2009 meeting,
and currently claiming to be the Secretary of CKLN's Board of
Directors, supplied a response Affidavit. There was no response to the
Duffell Affidavit.
It is interesting that although current so-called "CKLN Board
members", Ron Nelson and Michael Harnett (the person elected with Ms.
Young at that aforementioned November 2008 AGM) and Peter Toh (a
recently departed Board member) played very key roles throughout the
recent CKLN saga, none of them would swear a statement in the case.
More often than not, Lehrer says he is relying on Nelson for
information to respond to Mary's Affidavit, and that information is
often very flawed.
As part of the protocols of the Application, on Tuesday, December 22,
2009, Mary Young and Andrew Lehrer were each separately cross examined
by the respective lawyers in the case.
On January 6, 2010, Mary's lawyer will produce a factum for
presentation to the judge. About ten days following this, the CKLN
lawyer will respond. One week later on January 22, 2010 there will be
a hearing and a judge will rule. I am not sure if this hearing will be
in public.
Of course, it is unclear what the judge's decision will be. If the
judge feels that there are too many areas of important or substantial
disagreement about the facts in the case, the whole matter could be
pushed to a full blown trial, with affidavits of documents,
discoveries, subpoenas, witnesses called and so on. On the other hand,
if the judge is satisfied about the veracity of the major facts, there
could be the beginning of a solution to the CKLN situation right there
and then.]
