Hello everyone,
I am new here. this is my first time joining a seduction community group here. I just found this event. It looks really awesome and I like to know if anyone is interested in going so maybe we can meet up there because I already bought my ticket and I'd like to meet some local wings... www.puasummit.com. Actually you're wrong on several counts, the primary one being that
the case
you cite was about communist party members claiming that identifying
themselves
to the government violated their right against self-incrimination.

Let me summarize, for the LAST time, why I defied the court ordered
psych exam:
1. The refusal to allow me an interlocutory appeal prior to
submitting to the
examination constitutes a due process violation because the exam
constitutes a
"loss of liberty." The constitution prohibits the loss of liberty
without "due
process of law," and I consider an interlocutory appeal to be part of
that due
process. In other words, if they made me take the exam, THEN I
appealed the
order after the case was over (non-interlocutory), and the appeal was
granted,
the exam couldn't have been undone, and I would have suffered an
irreversible
(and preventable) loss of liberty.
2. I am challenging the nature of the "independent medical exam" as
anything
but. I believe the court, and not the defendant, should have selected
the
examiner. Had they done this, I would have gone.
3. I am challenging the relevance of the examination as it relates to
perceived disability, given that case law in the third circuit states
that an
individual who is perceived as disabled is treated as if s/he has the
disability. In other words, for the purposes of the
perceived-disability
claim, whether or not I had the disability was moot.
4. I am challenging the examination on the grounds that since I had
pulled the
count of actual disability from the complaint, and had also yanked the
claim
for damages based on emotional distress, that there was no need to
assess my
mental status. It is worth noting that Penn tried to get the other
three
counts dismissed because of the exam, but Judge Brody said that she
would have
"none of that" because it would allow all Title VII defendants to
question the
applicant's employability.
5. I am challeging the examination because I believe it is
retaliatory and
violates the public interest to subject Title VII litigants to
compulsory psych
exams when in the absence of Title VII litigation, they would have no
grounds

Actually you're wrong on several counts, the primary one being that
the case
you cite was about communist party members claiming that identifying
themselves
to the government violated their right against self-incrimination.

Let me summarize, for the LAST time, why I defied the court ordered
psych exam:
1. The refusal to allow me an interlocutory appeal prior to
submitting to the
examination constitutes a due process violation because the exam
constitutes a
"loss of liberty." The constitution prohibits the loss of liberty
without "due
process of law," and I consider an interlocutory appeal to be part of
that due
process. In other words, if they made me take the exam, THEN I
appealed the
order after the case was over (non-interlocutory), and the appeal was
granted,
the exam couldn't have been undone, and I would have suffered an
irreversible
(and preventable) loss of liberty.
2. I am challenging the nature of the "independent medical exam" as
anything
but. I believe the court, and not the defendant, should have selected
the
examiner. Had they done this, I would have gone.
3. I am challenging the relevance of the examination as it relates to
perceived disability, given that case law in the third circuit states
that an
individual who is perceived as disabled is treated as if s/he has the
disability. In other words, for the purposes of the
perceived-disability
claim, whether or not I had the disability was moot.
4. I am challenging the examination on the grounds that since I had
pulled the
count of actual disability from the complaint, and had also yanked the
claim
for damages based on emotional distress, that there was no need to
assess my
mental status. It is worth noting that Penn tried to get the other
three
counts dismissed because of the exam, but Judge Brody said that she
would have
"none of that" because it would allow all Title VII defendants to
question the
applicant's employability.
5. I am challeging the examination because I believe it is
retaliatory and
violates the public interest to subject Title VII litigants to
compulsory psych
exams when in the absence of Title VII litigation, they would have no
grounds
