Wow. They do this with Narconon victims and their loved ones, too. I
commented at the article on specific violations I have encountered
where private medical information is used illegally and wontonly to
try and discredit them in their credit card charge back claims.

This is a cult without a conscience and it's days are numbered, for
sure.

In medical terms this is a HIPAA problem.

Here is one example of the cult garnering fair game material, and

Indeed. Going into peoples private medical records is pretty fucking
low... and trying to use that as an excuse to ban them from their
constutional lawful actions... No fair game indeed:P

As to our HappySmurf and AGP... Well, makes me understand them better.
Why they do what they do and why consequences are not that
terrifying.. There's a clock ticking and life is not that long ahead.
Also, they can screw each other for the fun of it if they feel like it
if they haven't yet and know they aren't potentially killing the
other. :P

Sure. I know why.

Because the Church wants to make absolutely certain 100% SURE that
anyone they are attacking these days through their OSA staff are people that
ARE actually disqualified from and/or barred from services per policy.

Anyone who has AIDS may not join staff, the Sea Org, or receive any
auditing or training at any org or mission anywhere. Because AIDS is listed
as a terminal illness once contracted and LRH policy states "No one with
terminal illness may get auditing, training or become staff anywhere".

If the people OSA is attacking don't know this, then they would be under
the mistaken impression that they were entertaining Scientologists rather
than protesting them.

One has to make sure one knows EXACTLY what one is getting into, most of
the times, when it comes to Scientology.

A simpler method would be to have a spy within the ranks of the
protesters. And coincidentally, there is a person who fits that bill
pretty well. He's even admitted to spying on protesters in the past.

They need to find out the source of the leak. Personally I would start
with asking their primary care phsyicians and any specialists they see
if anyone has requested their medical records as of late. Its
difficult to get records released fraudulently, but not impossible.
All they need is a forged signature and a fax machine, really. There
would be a copy of the hipaa release form on file with the doctor who
released the info... provided that was the source of the information.
A spy or some other way of obtaining info are easillly possible. This
is really disgusting. There is a special place in hell for the scilons
who did this shit.


FYI, pentalties for violating HIPAA laws:

Penalties for violations of privacy

The Privacy Rule includes both civil and criminal penalties for
violations of privacy. Generally, penalties are expected to be
assessed in cases where organizations or individuals act with willful
neglect or intent to cause harm. Civil penalties are specified at $100
per violation, not to exceed $25,000 per person per year for identical
violations. Criminal penalties for wrongful disclosure of PHI can go
up to $250,000 and/or 10 years imprisonment if the offense is
committed with intent to sell, transfer, or use PHI for commercial
advantage, personal gain, or malicious harm.

Angry Gay Pope has said several times, on the WWP board, that the
information was obtained through his debit card records. I haven't
seen where he explained how he knows that, but he seems certain of it.

Yes, and while it was addressed by the board, the deputy/ assistant
county sheriff he asked confirmation of conveniently failed to answer

Nothing surprises me about this cult. I wonder if they have someone
working at a place that has dircect access to VISA debit and credit
card information. It's not unlikely.

Recently,when Arnie Lerma was in FL getting his surgery, he went to
his hotel, a major hotel in Tampa, to recuperate and make visits to
the outpatient center. Before he even got out the door for his first
visit back after surgery there was a PI sitting in the lobby, a
familiar one from the past whose photo is posted on lermanet. He wrote
about this. He told me that he believes the cult got his hotel
whereabouts from his credit card which he used to pay for his room
( even though he checked in under a pseudonym).

ps: After a couple of days of seeing this guy around, Arnie went and
uploaded the photo of the PI from lermanet and made it a screensaver
on the hotel lobby computer for all to see, lol!! Wasn't too much
later that the guy got up, left and never came back, :)

The question I've got is regarding the illegal obtaining of medical records
in the cases of people who've never been members of the cult, but rather
persecuted by them. While I already understand Fair Game policies (and do
I!), is there something specific regarding the medical records of EssPees
and other "Criminals"?

Wow! I am really looking forward to the day when we have
congressional hearings on Scientology as an organized crime outfit
who extorts and blackmails it'a enemies, including the US government.
That way victims of this kind of stuff can testify without fear of
retribution, without gag agreements silencing them and without having
persobnal information, including confessional and auditing folder
contents, held over their head.

This makes me think of the articles I posted above wherein Isaac Hayes
and the cult's outlet in Harlem seemed to have garnered some HIV/AIDS
awareness position under the auspices of fed dollars.

Like they want to publicly cry, "cooties!" of another kind, as they do
to their own members creating the inferior and discriminatory "BT's."
Divide and conquer protesters, and divide and conquer CDC money at the
same time?

Imagine them doing this to people, as they pose as advocates with
possible CDC grants.

I bet the cult helps to love AIDS babies, too. For the extraction or
protection of their own...money.

Has ARS by now been taken over completely by the "Anonymous" lunacy, and
we're no longer allowed to call Garry Scarff Garry Scarff, but we must
refer to him by oblique references like yours, or use the pseudonym "Happy
Smurf" instead?

It just beggars belief that anyone who's followed the
Scientology-vs.-critics story for some time, let alone someone with the
personal experience of dealing with Scientology that Graham Berry has,
could possibly get involved in a three-man picket one third of which is
Scarff, and then act all surprised and offended that (allegedly) personal
information leaks out to Scientology. Frankly, anybody who gets in bed with
Garry Scarff gets what they deserve. I don't know who this "Angry Gay Pope"
character is, but certainly Graham Berry can't plead ignorance. Just what
strange kind of selective amnesia is at work here?

Garry is amusing in his own way I just wouldn't trust him with anything I
wanted kept secret, like the proverbial village postmistress.
