INUNDATE the court with a groundswell DEMAND THAT Ed and Elaine's

Judge to Browns: Attend your trial Skipping it would be 'suicide pact'

A federal judge tried - and failed - yesterday to persuade Ed and
Elaine Brown to consult with lawyers and participate in their upcoming
trial for conspiracy, weapons and obstruction of justice charges. The
couple said they would prefer to sit the trial out.

In a conversation with Elaine Brown, Judge George Singal described the
couple's legal strategy as "almost a suicide pact" and said the couple
had little chance of avoiding guilty verdicts without changing course.

"I am concerned at this point in your life, you're heading towards the
edge of a cliff without a second thought," Singal said.

The Browns were convicted of tax-related felonies in 2007 but escaped
arrest for nearly nine months in their castle-like Plainfield home,
where they entertained guests, accumulated bombs and weapons, and
threatened violence if federal agents tried to arrest them. They were
apprehended by a team of undercover U.S. marshals disguised as
supporters.

The Browns now face a combined 11 felonies and virtual life sentences.
The mandatory minimum punishment for the most serious charge, for
possessing "destructive devices," is 30 years in prison.

Since their arraignments in February, the couple have rejected the
help of court-appointed attorneys, refused to review discovery
materials and filed a series of motions on their own behalf, most of
which have been dismissed as frivolous.

At the request of a lawyer appointed to help Elaine Brown, Singal
spoke to her in the courtroom without her husband or prosecutors
present. The lawyer, Bjorn Lange, had argued in a motion that Elaine
Brown's actions showed evidence of delusion and that family members
believed she was being controlled by her husband.

Singal has not yet ruled on a request to evaluate Elaine Brown's
mental competency, but he did agree to the separate interview to
determine whether she would choose a lawyer's help.

Elaine Brown said no. Speaking in a deliberate and respectful tone,
she said her principles and personal views about the law would not
allow her to participate in the federal court proceedings.

"I cannot consent to re-enter your court and play by your rules," she
said. "I am prepared for the consequences because there is a greater
justice."

Michael Iacopino, the lawyer appointed to assist Ed Brown, has not
filed a motion questioning Ed Brown's competency, but in a series of
questions yesterday, Singal appeared to probe the issues necessary for
making such a determination. During the conversation, Ed Brown
explained that he understood the proper functions of the judge, jury,
prosecutors and defense attorneys during a criminal trial - elements
of the legal requirements for competency.

Like his wife, Ed Brown refused to consult his lawyer and indicated
that he preferred not to attend the trial, scheduled to begin later
this month.

"I don't live in this legal fiction world," Ed Brown said.

Singal said he would try to respect the couple's wishes not to be
present at trial, but he cautioned them to reconsider and talk about
how their absence might hurt their chances. Singal said he had made
arrangements so that the Browns could listen to an audio stream of
their trial from afar. He also told them that they would need to enter
the courtroom for parts of jury selection and to be identified by
certain witnesses.

"It's better for you to be in court than to have an empty chair,"
Singal said.
