Back on the same day that John McCain chose Sarah Palin as his vice-
presidential candidate I started investigating Palin's past on illegal
immigration. I invited others to send in anything they found. There
was nothing on the record. Many did write in and said that Laura
Ingraham said that one time she was talking to Palin and she said she
was against amnesty. That was the only statement anywhere that could
be found.
Now we know that she is against amnesty, all the while she is for it
with a "pathway to citizenship"."

built Fort Saint Louis near Matagorda Bay and claimed for France all
the lands drained by the Mississippi River and its tributaries. Soon

Migrants are sending more cash back home
WASHINGTON - Latin American migrants in the United States will send a
record $45 billion to support relatives back home this year, according
to a study released Wednesday that sheds new light on the powerful
economic forces driving migrants -- legal and undocumented -- to
America's labor-hungry regions.

Boulder employer indicted for defrauding his foreign national employees

A 51-year-old Boulder employer has been indicted by a federal grand jury
in Denver on charges of defrauding his foreign national employees,
harboring illegal aliens and other immigration and tax related charges.
Opas Sinprasong surrendered Thursday and made his initial appearance in
U.S. District Court in Denver.
According to the indictment, Sinprasong was a citizen of Thailand who
was in the United States on a “non-immigrant principal investor” status.
While in the country, he ran Thai and Japanese restaurants in Boulder,
Louisville and Broomfield, including Siamese Plate and Sumidas and
Siamese Plate on the go.
From 2001 to 2008, Sinprasong sponsored Thai nationals admission to the
United States as specialty workers for his restaurants and claimed in
immigration applications that they had specialized skills essential to
the efficient operation of his business. The Thai employees were
admitted to the United States for terms of two years, which could be
extended for an indefinite number of terms, according to the indictment.
Sinprasong required all his Thai employees to enter into a two-year
employment contract with specific terms, according to the indictment.
They were required to pay Sinprasong a “bond” of 50,000 Thai baht, which
is about $1,500 U.S. dollars.
Employees were liable to the defendant for a penalty of 600,000 Thai
baht, or about $18,000 U.S. dollars, if they violated a term of the
contract or caused damage to Sinprasong.
Each employee was required to obtained a personal guarantor in Thailand,
who entered into a contract with Sinprasong making the gaurantor liable
for the penalty if the employee violated a term of the contract or
caused damages.
Employees had to pay Sinprasong a $3,000 “visa preparation fee” after
arriving in the United States.
Sinprasong usually directed them to start work at his restaurants upon
arriving to the country, and he paid them “under the table” while
deducting portions of the $3,000 visa fee and other fees from the
payment check, the indictment said. Once the fees had been paid in full
— it typically took between three and four months — Sinprasong helped
the employees obtained Social Security numbers and then started to
report a portion of their wages, according to the indictment.
The defendant devised a scheme to defraud the Internal Revenue Service
and the Thai employees, in part, by using a dual payroll system whereby
he hid from his payroll records substantial overtime hours he made the
Thai employees work — typically between 26 and 32 hours of overtime each
week, the indictment said.
Sinprasong is accused of failing to report all of the wages he paid the
Thai employees and failing to pay the Thai employees the overtime wages
that are required by federal law.
The quarterly federal tax returns that Sinprasong filed were “material
false in that they failed to report the total wages paid to the Thai
employees,” according to the indictment. By doing so, Sinprasong evaded
paying the employer's portion of the Social Security and Medicare taxes
due and owning on the unreported wages.
“Mr. Sinprasong took advantage of vulnerable people, while at the same
time lying to and defrauding our government,” U.S. Attorney David
Gaouette said in a news release. “Such criminal conduct cannot be
tolerated.”
If convicted, Sinprasong faces up to 20 years in federal prison and up
to a $250,000 fine for each count of wire fraud. He faces up to five
years in prison and up to a $250,000 fine for each count of failure to
pay employee federal payroll taxes. Sinprasong faces up to 10 years in
federal prison, and up to a $250,000 fine for each count of false
swearing in an immigration matter.
Finally, Sinprasong faces up to 10 years in prison and a fine of not
more than $250,000 for each count of harboring illegal aliens.
The indictment also seeks forfeiture of property.
The U.S. Immigration and Customs Enforcement and the IRS Criminal
Investigation Denver Field Office investigated the case.
Sinprasong's next scheduled appearance in U.S. District Court in Denver
is on February 17, 2010 for arraignment and a detention hearing.
