Judiciary Committee Members Voted Along Party Lines

The Democratic-controlled Senate Judiciary Committee voted along party lines
Thursday to kill the nomination of Judge Charles Pickering to the appeals
court, handing President Bush a stinging defeat in a racially-charged
confirmation battle.
In a series of roll calls, the panel also snubbed Bush's request to allow a
vote in the full Senate on Pickering, a 64-year-old Mississippian with more
than a decade on the bench.
Pickering does not have "the temperament, the moderation or the commitment
to core constitutional ... protections that is required for a life tenure
position" on the appeals court," said Sen. Edward M. Kennedy, one of an
unbroken string of committee Democrats to argue against confirmation.
Republicans were equally united in their support of Pickering. Sen. Orrin
Hatch, R-Utah, argued that Bush's nominee had been victimized by a smear
campaign by liberal interest groups seeking to impose "an ideological litmus
test" on abortion, civil rights and other issues.
The committee's actions left the nomination all but dead. The GOP leader,
Sen. Trent Lott - Pickering's friend and Mississippi patron - has authority
to seek a vote by the full Senate, but such efforts are customarily settled
on party-line votes.
Supporters and opponents of Pickering's confirmation filled the large
committee room. Supporters wore pink badges that said "Stop the Bickering
Confirm Pickering."
The debate, which stretched over more than four hours, ranged far from
Pickering's case. Republicans noted - with dissatisfaction - numerous public
predictions that the confirmation battle was a warm-up for any Supreme Court
nominations that Bush might make.
Democrats repeatedly accused Republicans of mistreating many of the
nominations made by former President Clinton, to the point of denying
hearings for months at a time.
Pickering was not present, but his son, Rep. Charles Pickering, R-Miss., had
a seat in the front row of the spectators section. "What is happening to
your father today is a great injustice," said Sen. Mitch McConnell, R-Ky.,
addressing his remarks to the young congressman.
Bush made a few late calls on behalf of his beleaguered nominee in the
run-up to the committee meeting, but there was no indication that Democrats
were wavering in their plan to deny Pickering a floor vote.
Senate Majority Leader Tom Daschle told reporters the president was "asking
us to break a 200-year tradition" of Senate committees holding jurisdiction
and responsibility for approving nominations. "I don't know that we can do
that," he said.
"By failing to allow full Senate votes on judicial nominees, a few senators
are standing in the way of justice," Bush had said.
Democrats "seek to undermine the nominations of candidates who agree with my
philosophy that judges should interpret the law and not try to make law from
the bench," the president said at his news conference a little less than 24
hours before the committee met.
The debate Thursday unfolded along party lines, and it seemed at times as
though there were two nominees up for confirmation.
The committee chairman, Patrick Leahy, said Pickering "repeatedly injects
his own opinions into his decisions on issues ranging from employment
discrimination to voting rights."
Other Democrats referred to a case in which Pickering had sought a lighter
sentence for a defendant on a cross-burning case - a case that Republicans
said was misinterpreted by the judge's critics.
Democrats said Pickering's ruling in voting rights cases had been overturned
by the appeals court. Republicans countered the reversal had to do with
attorney fees, not the merits of the case.
Sen. Charles Grassley, R-Iowa, praised Pickering for "moral courage on the
issue of race," demonstrated in 1967 when he testified against a Ku Klux
Klan leader in Mississippi.
Much of the opposition to Pickering, 64, has come from civil rights groups,
which say he supported segregation as a young man in Mississippi.
Pickering's opponents also point to his conservative voting record as a
Mississippi state lawmaker and decisions as a judge.
Supporters, including some Mississippi Democrats and black leaders, cite
numerous examples of support for civil rights as far back as the middle
1960s and note that Pickering won Senate confirmation in 1990 to be a U.S.
District Court judge.
Forty of the 92 Bush judicial nominations have been confirmed by the Senate,
most of them District court judges. Seven of Bush's 29 nominees to the U.S.
Appeals Court, the regional courts one step below the Supreme Court, have
been confirmed.

Pickering is collateral damage in the on-going war for a representative
judiciary. Repubs were the ones who started the effort to pack the courts with
partisans by blocking Clinton's nominees. Pickering paid for their sins. It
looks like he won't be the last to make the ultimate Federalist Society
sacrifice.

What comes around goes around. The Republicans skewered qualified Clinton appointments on ideological grounds,
and now they think the Democrats should just give in to anything they want?
I don't think so.
Of course, almost all of Bush's appointments to appeals courts have been approved, and the Democrats haven't used
this power as often and as blatantly as the Republicans. If the GOP hadn't started bottling up Clinton
appointments in the way they did, then it wouldn't have gotten to this point. Turn about is fair play.
Sure, make a recess appointment. That can be part of the game, though that can also hurt the long term ability of
Bush to get what he wants from Congress. This is politics. And the Democrats are giving back to the GOP what the
GOP dished out. Shame on both? Perhaps. But it would be naive for the GOP to think they can get away with it
while a Democrat is in power and then expect the Democrats to fold once they get power.

I suppose you have evidence other than your hatred for Kennedy.
But either way; it's over, and it's been over for 30 years. To be fair, I
agree he should have been punished more than he was, and he certainly
shouldn't have been re-elected at the time. But he wasn't, and he was, and
it's been more than 30 years, and the world has moved on.
No one knows all of the circumstances surrounding it, and even so, DUI
wasn't taken very seriously back then at all. A lot of people were killed
suring DUIs and no one ever prosecuted. Unfortunately, it's still that way
far too often.

Turn about is fair play, that's politics. What the GOP
did was shameful, maybe its shameful for the Democrats
to do the same thing back (though, arguably, they
aren't doing it as often as the GOP did), but certainly
you can see their position that if the GOP is going to
play that game, they can't just fold when the tables
turn.

Depends on the definition of "qualified"
It is not a good qualification to have problems with common, accepted,
legal doctrines and make judgments that run counter-purpose to them
It is not a good qualification to allow personal bias and preferences
to subvert following established legal doctrine.
And Pickering (among other things) is guilty of that.

Given that a majority of the full Senate was prepared to confirm Pickering, there is
little risk in a recess appointment. And it would again highlight the extremism of
Daschle and his obstructionist cohorts.

There were many nominations they rejected. For the
courts, they not only stalled, they refused to consider
them -- arguably something worse than what the
Democrats did in at least taking it to a committee
vote. The Clinton administration learned that only
right of center to moderate nominees had a chance, the
rest would die.
Turnabout is fair play.
Ultimately, the two sides will have to realize that
such games on each side are counter productive, but I
doubt the Democrats will give in until they at least
feel that they've made their point and can trust that
the GOP won't renege on some kind of new procedure as
soon as the tables turn once again (and the tables
always turn).

What is called a republic is not any particular
form of government. It is wholly characteristical
of the purport, matter or object for which
government ought to be instituted, and on
which it is to be employed, Res-Publica, the

hereditary stadtholdership. But the
government of America, which is
wholly on the system of representation, is
the only real Republic, in character and in
practice, that now exists. Its government
has no other object than the public business
of the nation, and therefore it is properly a
republic; and the Americans have taken
care that this, and no other, shall always be
the object of their government, by their
rejecting everything hereditary, and
establishing governments on the system of
representation only. Those who have said
that a republic is not a form of government
calculated for countries of great extent,
mistook, in the first place, the business of a
government, for a form of government; for
the res-publica equally appertains to every
extent of territory and population. And, in the
second place, if they meant anything with
respect to form, it was the simple
democratical form, such as was the mode of
government in the ancient democracies, in
which there was no representation. The case,
therefore, is not, that a republic cannot be
extensive, but that it cannot be extensive
on the simple democratical form; and the
question naturally presents itself, What is the
best form of government for conducting the
Res-Publica, or the Public Business of a
nation, after it becomes too extensive and
populous for the simple democratical form?
It cannot be monarchy, because monarchy
is subject to an objection of the same amount
to which the simple democratical form was
subject.
It is possible that an individual may lay down
a system of principles, on which government
shall be constitutionally established to any
extent of territory. This is no more than an
operation of the mind, acting by its own
powers. But the practice upon those
principles, as applying to the various and
numerous circumstances of a nation, its
agriculture, manufacture, trade, commerce,
etc., etc., a knowledge of a different kind,
and which can be had only from the various
parts of society. It is an assemblage of
practical knowledge, which no individual
can possess; and therefore the
monarchical form is as much limited, in
useful practice, from the incompetency of
knowledge, as was the democratical form,
from the multiplicity of population. The one
degenerates, by extension, into confusion;
the other, into ignorance and incapacity, of
which all the great monarchies are an
evidence. The monarchical form, therefore,
could not be a substitute for the
democratical, because it has equal
inconveniences.
Much less could it when made hereditary.
This is the most effectual of all forms to
preclude knowledge. Neither could the
high democratical mind have voluntarily
yielded itself to be governed by children
and idiots, and all the motley insignificance
of character, which attends such a mere
animal system, the disgrace and the
reproach of reason and of man.
As to the aristocratical form, it has the
same vices and defects with the
monarchical, except that the chance
of abilities is better from the proportion
of numbers, but there is still no security
for the right use and application of them.
Referring them to the original simple
democracy, it affords the true data from
which government on a large scale can
begin. It is incapable of extension, not
from its principle, but from the
inconvenience of its form; and monarchy
and aristocracy, from their incapacity.
Retaining, then, democracy as the
ground, and rejecting the corrupt systems
of monarchy and aristocracy, the
representative system naturally presents
itself; remedying at once the defects of
the simple democracy as to form, and
the incapacity of the other two with
respect to knowledge.
Simple democracy was society governing
itself without the aid of secondary means.
By ingrafting representation upon
democracy, we arrive at a system of
government capable of embracing and
confederating all the various interests and
every extent of territory and population; and
that also with advantages as much superior
to hereditary government, as the republic of
letters is to hereditary literature.
It is on this system that the American
government is founded. It is representation
ingrafted upon democracy. It has fixed the
form by a scale parallel in all cases to the
extent of the principle... It is the easiest of
all the forms of government to be understood
and the most eligible in practice; and excludes
at once the ignorance and insecurity of the
hereditary mode, and the inconvenience of

1. Using this concept to justify "borking" Pickering is childish. Further,
it is another example of moral equivalency -- "you did it too" -- used to
justify committing a "wrong" act.

The democrats have lit the match that will start the fuze of their one
destruction because of this partisan activity. I have never seen

appellate judge and liberal US representative Abner Mikva's advice is
followed (as it seems more likely than not) that democrats should prevent
ANY Bush judicial nomination form succeeding (under the theory that Bush is
not the legitimate President) the reaction will permanent poison polity and
Republicans will have no reason to refrain from political violence in
retaliation. And that would be very serious and dangerous.
Catering to the demands of the People for the American Way and other leftist
groups could cost the democrats the south next November -- according to Zell
Miller. In fact, it may even cost us our republic as well.

No one can deny the way Republicans stalled and killed numerous Clinton
nominees, and forced Clinton to only nominate center to right candidates. The
Democrats have been giving Bush most of what he wants, including Ashcroft and
every other major nominee.

it is not unAmerican to critize the record of nominees -- 'borking' is a
silly concept. Bork was manifestly unfit to be on the SC -- his
subsequent writings and behavior show us how we managed to dodge a bullet
there. The testimony against Ashcroft and Pickering is spot on. And
Ashcroft's behavior in office is an insult to those democratic Senators
who refused to stand up against him -- the man is a disgrace.
Pickering's attempt to bully lawyers practicing in his courtroom to
support his nomination clinches the argument that this man is unfit for
the bench.
Are you kidding??!!! Do you know how many nominations were allowed to die
for lack of action, and how many were held up. Jesse Helms refused to hold
hearings on some.
