California's Top Court Overturns Gay Marriage Ban
by Lisa Leff, Associated Press Writer

SAN FRANCISCO - In a monumental victory for the gay rights movement,
the California Supreme Court overturned a voter-approved ban on gay
marriage Thursday in a ruling that would allow same-sex couples in the
nation's biggest state to tie the knot.

Domestic partnerships are not a good enough substitute for marriage,
the justices ruled 4-3 in an opinion written by Chief Justice Ron
George.

Outside the courthouse, gay marriage supporters cried and cheered as
news spread of the decision.

"Our state now recognizes that an individual's capacity to establish a
loving and long-term committed relationship with another person and
responsibly to care for and raise children does not depend upon the
individual's sexual orientation," the court wrote.

The city of San Francisco, two dozen gay and lesbian couples and gay
rights groups sued in March 2004 after the court halted San
Francisco's monthlong same-sex wedding march.

"Today the California Supreme Court took a giant leap to ensure that
everybody — not just in the state of California, but throughout the
country — will have equal treatment under the law," said City Attorney
Dennis Herrera, who argued the case for San Francisco.

If same sex marriage is now a right in California, then so should be
polygamy.

Why?

My wife and I are friends with many gay couples.
Most of them have a better relationship than our straight couple friends.

One couple had a person who took a job because his benefits could be
extended to his partner. One of them was in a car accident and landed in
ICU.

You had a man whose benefits were paying the bills.
But he couldn't see his partner because it was family only.

Tell us how that works???

You're comparison of same-sex marriage to polygamy is false one. The
judges ruling was on the right of one person to marry one other
person.

By your twisted "logic", the right of people of different races to
marry one another, something which also was *against* the law, would
mean that polygamous marriage should be legal.

Yet you keep making it, because you have no valid reason to argue
against same-sex marriage.

You truly do not understand what a stupid and foolish *claim* you are
making.

Just so you know, the California Supreme Court's ruling in favor of
this marriage also states any ballot attempting to overturn it would
also likely be found unconstitutional.

You've lost. With time, you will *always* loose.

Please explain how it is appropriate for two people of the same sex to
marry, but it isn't appropriate for one person to marry several people
of the opposite sex.

Laws against same-sex marriage are sex discrimination. If the only reason

I see.

So, the only reason that polygamy is wrong is because the law says that
it is. Using your definition of discrimination, it seems that if laws
against same sex marriage are unconstitutional discrimination, then the
same is true for laws against polygamy.

Ask the same sex marriage folks. I am merely trying to make the point
that since same sex marriage is now legal in California, we can expect
polygamists to move to California and make the claim that they also have
a right to their definition of marriage.

It is because polygamy isn't a politically correct issue, and homosexuals
are. I personally don't care how someone else gets their jollies, but
changing the meaning of word (marriage) to include homosexuals is a bunch of
crap. Anyone should be entitled to a legal civil union whether they are
homosexuals or not, including heterosexual couples. But, the latest CA SC
ruling is just a statement by the court saying "welcome to California".

Homosexual people do not contend that people should be able to have whatever
marital arrangement they want. They contend only that everyone should have
access to marriage as heterosexual people do. They do not argue for any
additional legal rights other people do not have. Instead, they argue that
they are uniquely denied a right everyone else already has — the right to
marry someone they love.

In this context, polygamy is nothing more than a strawman. The same goes
for incest and Bill O'Reilly's favorite topic, marrying an animal.

It is not yet a societal norm that men can marry men, or that women can
marry women. That is why it is taking court decisions to force the issue.

Which means that polygamy is as valid as same sex marriage.

I have been married for almost 28 years, I have never considered my
marriage license to be a contract. When did this definition come into being?

The license, of course, is not a contract. The marriage is. That, after
all, is the origin of marriage, and was for thousands of years before
religion decided to stick its nose into it in about the ninth century CE.

I have signed a number of contracts in my day. Every last one of them
has the terms of the contract as part of the contract body. My marriage
license has no terms specified. Where might i find the terms of this
marriage "contract"?

The voter initiative is for an amendment to the California Constitution
which would prohibit same sex marriage.

It would seem that it may be premature for Ms Degeneres to be planning a

It is not sex based. A man and a women can marry, there is no law that
says a women can't marry because of her sex. The constitution does not
grant the right of a father to marry his daughter is that
discrimination? The simple point is be the judges Dem or Reps, the

Of course it is.

> A man and a women can marry, there is no law that says a women can't marry
> because of her sex.

This was exactly the reasoning used to defend miscegenation laws: whites can
marry whites, blacks can marry blacks, so everyone has a right to marry.
That was nonsense when it was applied to race, and it is nonsense when it is
applied to sex.

Of course it is sex discrimination. If the words "man" and "woman" in the
statutes providing for marriage are replaced by "person," the problem
disappears.

> The constitution does not grant the right of a father to marry his
> daughter is that discrimination?

No. He can't marry his son either. He cannot marry his dog, regardless of
the breed, sex, religion, or national origin of the dog. He cannot marry a
corpse regardless of the corpse's sex.

Everyone is forbidden to marry within a certain degree of consanguinity
(varies by state). Everyone is forbidden to marry a child (age of consent
varies by state). Everyone is forbidden to marry an inanimate object, a
dead person, an animal, or anything other than another unmarried person of
the age of consent. That is not discrimination. It is when the prohibition
is contingent on the person's race, sex, national origin, religion, etc.
that it is discrimination.

> The simple point is be the judges Dem or Reps, the interpretation is bad
> law.

The equal protections of the laws is not bad law.

It's getting difficult to follow the quoting in this. However, I
think it is fairly clear who is writing what above.

Tucker is yet another one, like Patriot Games and a number of other
ultraconservative fanatics in the political newsgroups, who believe
they worship and serve God, when actually their true Master is Satan.

Because of their own blind hatred, they fail to understand that God is
Love and that it is Satan that is Hate.

With every hate-filled thought they think, and write, and do, they
truly follow Satan.

Also very basic to all religious, bigoted fanatics is they are never
able to understand that with regards to gay relationships and same-sex
marriage, that this is about *LOVE*.

Due to their distorted, limited, twisted view of the world, they
cannot comprehend the feeling and thought that gay marriage is *truly*
about who a person loves.

The idea that two gay people can love one another is beyond them.
Because of their *own* base and animalistic morals and beliefs, they
fail to understand there is far more to gay relationships and marriage
than sex, just as there is far more than sex to heterosexual
relationships and marriage.

Because such people as Tucker and Games live in Hate, they cannot and
will not ever understand Love.
