CALIFORNIA GOVERNOR SIGNS SENATOR CORREA MOBILEHOME REFORM BILLS
Senator Lou Correa (Orange County) today thanked Governor Schwarzenegger for
signing all of his 2009 mobilehome and manufactured housing bills into law
over this past weekend.
Senator Correa, chair of the Senate Select Committee on Manufactured Homes
and Communities, said, "Senate Bills 111, 224 and 398 will make incremental
but important changes for mobilehome owners and residents of mobilehome
parks and manufactured housing communities."
SB 111 (Chapter 559, Statutes of 2009) reorganizes the utility provisions
of the Mobilehome Residency Law (MRL), often referred to as the
landlord-tenant law for mobilehome parks, by regrouping scattered sections
into one new article under the MRL entitled 'Utilities.' "The bill," said
the Senator, "will make these sections of the MRL easier to find and
understand."
SB 224 (Chapter 172, Statutes of 2009) provides that local agencies
administering state CalHome housing assistance funds cannot discriminate in
making loans or grants to low-income mobilehome owners solely on the basis
that the home is a mobilehome or manufactured home, or that the home is
located in a mobilehome park. Senator Correa emphasized that the new law
also clarifies that low-income mobilehome owners, who must install ignition
resistant exterior components required by the state Department of Housing
and Community Development (HCD) on mobilehomes because they are located in
wildfire prone urban areas, shall be eligible for the purposes of CalHome
rehabilitation grants.
SB 398 (Chapter 586, Statutes of 2009) adds additional fire code categories
for which a local fire agency may assume fire code enforcement in mobilehome
parks, including combustible brush and vegetation clearance, flammable
liquid storage, hazardous materials storage and use, and open burning.
Senator Correa indicated that both SB 224 and 398 came about as the result
of recent hearings of the Senate Select Committee on wildfire safety in
mobilehome parks.
SB 224 will become effective immediately as an urgency measure. SB's 111 and
224 become effective on January 1, 2010.
