Civil suit accuses Li Peng of crimes against humanity

NEW YORK, United States (CNN) -- A judge has ordered former Chinese
Premier Li Peng to appear before U.S. federal court on civil charges in
connection with the 1989 deadly crackdown on pro-democracy protesters
in Beijing's Tiananmen Square.
U.S. District Judge William H. Pauley III ordered Li to either appear
or send counsel to an October 13 pretrial hearing in New York federal
court. Human rights groups did not expect Li to attend the session.
Li, now head of China's parliament, is accused in a civil lawsuit of
crimes against humanity, summary execution, torture, and arbitrary
detention that followed his declaration of martial law on May 20, 1989,
in an effort to end the protests.
The lawsuit was filed on August 31 by four Chinese dissidents -- who
had been student leaders that were arrested during the Tiananmen
protests -- and the brother of a protester killed in the conflict.
The lawsuit was served later that day to Li's security entourage. Li
was in New York when the lawsuit was filed. He had been attending the
United Nations' Conference of Presiding Officers of National
Parliaments.
Rights groups: Li ordered crackdown
The lawsuit charged that starting on June 3, 1989, People's Liberation
Army soldiers and the People's Armed Police -- using semi-automatic
weapons and armored cars -- used force to clear Beijing's streets of
demonstrators and civilians.
Human rights groups -- including the Center for Constitutional Rights,
which filed the lawsuit on behalf of the dissidents -- have said Li
gave the order for that crackdown.
The lawsuit contended that Li should have "sought to halt the egregious
abuses of human rights that occurred when troops began their assault."
Chinese officials have said the crackdown was necessary to restore law
and order.
There has never been a full accounting of the Tiananmen incident, and
an exact number of those killed during the crackdown has never been
made available. Estimates place the death toll in the thousands.
The protests had begun on April 17, 1989, when thousands of students
from various schools rallied at Tiananmen Square -- demanding their
constitutional rights to freedom of expression and assembly.
The students also pressed their demands for political reform and an end
of widespread corruption.
In filing the lawsuit, the plaintiffs argued that the U.S. court had
jurisdiction based on a 1789 U.S. law, known as the Alien Tort Claims
Act, that allows victims of torture or human rights abuses anywhere in
the world to demand reparation before a U.S. federal court.
If the court rules against Li, he could be ordered to pay monetary
damages, but he would not face a prison sentence.
First recognition
Human rights experts do not expect Li to appear before the court.
Plaintiffs in past lawsuits against international leaders have had
little success in U.S. courts, so the current suit could be seen as
largely symbolic.
However, rights activists said Pauley's decision was the first
recognition by an international legal system that the Tiananmen
crackdown involved human rights violations.
Four of the plaintiffs -- Zhou Suo Fen, Liu Gang, Xiong Yan and Wang
Dan -- had been on China's "most-wanted list" of 21 student leaders
following the protests.
"Some of those who were detained for up to two years did not have a
fair trial, or were held without any charges lodged against them,"
Jennie Green, attorney for the Center for Constitutional Rights, said
in August.
"These people lived in horrible conditions, were subjected to electric
shock and had little or no contact with families. They were arrested
when their names were posted on a 'most wanted list' with 17 other
student leaders," she added.

Belgrade Court Sentences Clinton

BELGRADE, Yugoslavia (AP) — A Belgrade court found President Clinton
and other world leaders guilty of war crimes and sentenced them — in
absentia — to 20 years in prison for NATO's bombing campaign against
Yugoslavia.
The four-day trial was held in an attempt to resurrect anti-NATO
sentiment here and win votes for President Slobodan Milosevic ahead of
Sunday's elections.
Belgrade's district court pronounced Clinton and 13 other leaders and
NATO officials ``guilty as charged'' and ordered warrants be issued
immediately for their arrest.
Court-appointed lawyers were hired to represent the defendants. As each
20-year sentence was read out separately, the crowd behind a row of 14
empty chairs bearing nameplates of the accused, stood and applauded.
``The accused were fully conscious of their actions, they perpetrated
the socially most dangerous acts,'' presiding judge Veroljub Raketic
told some 100 spectators and media present at the sentencing.
Clinton, Secretary of State Madeleine Albright, U.S. Defense Secretary
William Cohen, German Chancellor Gerhard Schroeder, British Prime
Minister Tony Blair, French President Jacques Chirac, as well as NATO
former Secretary-general Javier Solana and retired commander Gen.
Wesley Clark, were all accused last month of war crimes connected with
the 78-day 1999 bombing campaign.
``The accused had been notified and summoned to this trial through
their attorneys but they have ignored this court, either because they
were afraid of it or they were fully aware of their guilt,'' Raketic
concluded.
The Belgrade judge also ordered the defendants to pay the cost of the
trial and pronounced NATO guilty of the deaths of 546 Yugoslav army
soldiers, 138 Serbian policemen and 504 civilians — 88 of them
children.
Yugoslavia suffered heavily in the bombing, launched last year to halt
Milosevic's crackdown on ethnic Albanians in Kosovo.
Milosevic has campaigned on a mixture of anti-NATO slogans and self-
awarded kudos for leading the country's ``heroic reconstruction'' after
the bombing, apparently in the hope this will translate into votes on
Sunday.
The Belgrade prosecutor said there is no expiration date for the
crimes, and should any of the guilty parties come to Yugoslavia at any
time in the future, they would be arrested on the spot.
The charges, listed in a 120-page indictment, included ``inciting an
aggressive war and committing war crimes against a civilian
population,'' as well as use of illegal means of warfare, attempted
murder and ``violation of the territorial integrity'' of Yugoslavia.
During the trial, footage of the NATO bombing was shown, but no
witnesses testified, since the list of plaintiffs included ``all
citizens of Yugoslavia and no courtroom was big enough to hold all
witnesses,'' Raketic said.

Actually, many countries allow people to sue others who steal from
them, beat them up, imprison them without cause, and otherwise behave
like animals. IMHO that describes Li Peng quite well.
I don't think it's the Americans who are being arrogant here. It's
anyone who thinks that, just because Li Peng was a head of state in
another country, he should be held blameless for such behavior. :(
I don't claim the Chinese are arrogant about this -- I don't think
most Chinese have been allowed access to the full information, or are
free to say what they really think about Li Peng even assuming they
knew the facts.
But the Chinese government, and its supporters, have been
breathtakingly arrogant in their refusal to acknowledge the facts of
what happened at Tianenman square, in their refusal to quit torturing
and killing their opponent, and in their expectation that the rest of
the world will treat them as civilized human beings when they are
something less than barbarians.

victims of child abuse or don't have enough to eat or are worked

We need to clean our own house and then figure out if we even have the

others how to clean theirs.

I am going to cut some things from this post and admit your
right to debate that fact but tell the truth on what was cut.
I would suggest you might do your wife more honor by simply

Mark, have you ever studied what a mess the tree of humanity
is? Are you aware that there is no black race, no white race,
no yellow race, but that in truth there is a single Human Race
whose proper classification is Homo sapiens sapiens.

What really differentiates us is economic class and culture.
I find any oppression of the so called natural right of man to

dissidents, they have human slavery, as does our good brother on
the Arabian Peninsula, slave trading is still going on in
Africa. How can you, as a person claiming to be on the side of
good, live with that and not protest.
I could suggest a series of books to read that might help you
see some of what I'm writing about, but with a little work you
could do the same.
No, in all honesty, there is no generally accepted single place
that can be pointed to as the birth place of humanity. A lot of
remains that span from the present to as far back a 4 to 6
million years ago in the Rift Valley in Africa. There is also
slight but so far unrefuted evidence for a parallel form of
development of humans in China and Southern East Asia. If you
can provide some facts that go beyond the Eve hypothesis, and
some really ambiguous artifacts from other parts of the world, I
would enjoy discussing them with you.

No, they are still studied with ever more interest today. I
forced my younger son to learn Spanish. He is one of those rare
people who can learn a variety of languages and now speaks a
cultured Spanish that is admired by the Mexicans who live around

A personal issue with me that I have long screamed about. There
are sufficient treaties, that are superior to Federal Law, and
have been ignored that are supposed to give free passage between
our nations?
There is child abuse in this country but I suspect from some
research ( my Master of Science Degree is in Criminal Justice )
that most child labor law violations are in family farm and
small family businesses.
Why don't you do something about the pollution? China has the
right to dump more pollution than any other set of nations in
existence.

such. If it does I suspect that it would violate some

A quick lesson.
My neice spent a semester in Ireland. While there she was amazed at
the way people were. The everyday people were polite and repectful of
other people's space. One day she and a friend were riding the mass
transit system, (a bus I believe). They were peaking loudly and people
looked at them bewildred as to why since they were sitting right next to
each other.
Others were having discussions and conversations but there voice was
kept to a level to not disturb others around them.
I have learned that most are unaware that other people populate the
planet and so never even think about how what they do directly or
indirectly affects others.

I think that that is mainly up in the New York state area and

Nope. Human beings share over 99% of the same genetic makeup. The
less then one percent is controls the physical attributes displayed by
the different peoples from the different continents. You might consider
reading up on so recent and not so recent studies.

Why would you feel the need to shoot a person? His response is the
response of an individual whose existance is under attack. This does

I am not shy about my life. I have done nothing to hide so my life is
very much open to anybody interested. The attention that is not welcome
is the attention of data sellers and direct marketing association crap

Indentured servitude is slavery when you are indentured against your
will. The Scotsman I speak of were captured in battle when Scotland
fought against the English for their Independence. The captured were
shipped to the colonies to get rid of them and they were infact slaves.

I dropped AT&T around a year ago. If I need to make a long distance
phone call I will dial a few extra number. The mail is a funny thing
and this exercise is not one I would recommend for the faint of heart.

Because their is a less then one percent difference between the DNA of
any two individuals does in fact disprove any racist theory. You just
need to consider the slang term Race, in the context of Human Beings, is
inaapropriate since the term is slang for groups of like people. With
over a 99% exact same DNA sequencing everybody is so similar as to be of
one race as it is defined.

The netiquette issue Mark refers to is the manner in which I
posted a letter that I wrote to Victor Chan where he simply
stated the Fact that China is not bound by US law and he

the heart of the matter and agreed completely with him and gave
specific examples of where I agreed with his ideas. I would
like to hear from him because he sees clearly where so many do

Mark claims that skin color is a matter of evolution. That is
not the generally accepted that such traits are evolutionary but
rather represent what Darwin called speciation, and is
equivalent to the coloration of finches, all of whom can mate
and produce fertile offspring. I'm not sure how we share over

I described my actions toward two people who offended me over a
long time span.
In the first case a person presented what appeared to be a fine
and legitimate project that my company would subcontract to
produce a small golf cart. He lied about being able to
distribute and broke the contract in other legal ways. I stuck
a revolver literally up his left nostril and told him to get out
of dodge or I' kill him. He left.
In the case of another incident, a person made a habit of going
at a speed over 60m in front of my drive way. I confronted him
when he returned one day. He aimed the motorcycle right at me
to intimidate me into jumping out of the way. I have a lot of
spinal problems and don't jump well, so i pointed a 45 at him.
He stopped and started yelling about how I could not point a
pistol at him. I clicked the safety off and explained that he
was welcome to ride slowly past my drive way. I explained that
I would use him for a moving target next time he went too fast
by my driveway. The sheriff and his deputy said just to call
them if I had to kill him. He has not been back. Two other
riders came by. I called the sheriff since my wife did not want
me kill two people. The deputy showed up and when the riders
came back, the deputy did his work, and asked me what I wanted
to do. I explained to the riders what they had done to annoy
me. They said that they did not realize that they were causing
me offense and so I asked them to please go by my place more
slowly from now on. They have been back several times and have
honored their word.

2 Falun Gong Members Reportedly Killed

BEIJING (AP) — Two members of the banned Falun Gong sect have died in
custody, the latest deaths in China's crackdown on the spiritual
movement, a rights group reported Wednesday.
The deaths bring to at least 52 the number of Falun Gong followers who
have died in detention, the Hong Kong-based Information Center for
Human Rights and Democracy reported. While it has not commented on
every case, the government has denied the deaths were the result of
mistreatment.
In a letter to President Jiang Zemin, Falun Gong practitioners have
threatened to mount more protests if authorities detain sect members
ahead of National Day on Sunday.
``All the Falun Gong followers throughout China will go to Tiananmen
Square to peacefully petition'' for an end to the crackdown on the
group, said the letter dated Sept. 20. The letter was faxed to foreign
news agencies and posted on the group's U.S.-based Web site.
Before it was outlawed in July 1999, Falun Gong attracted millions with
its mix of exercise, meditation, Buddhist and Taoist philosophy and the
teachings of Li Hongzhi, who fled to the United States two years ago.
The communist government has mounted a media campaign to discredit the
banned sect. An editorial Wednesday by the state-run Xinhua News Agency
was typical fare, calling Falun Gong ``an evil, treasonous teaching''
and accusing it of causing more than 1,500 deaths.
In the latest case, state media reported Liu Hongfeng, a 36-year-old
elementary school vice principal, hanged himself at home in the
northern city of Lingwu on Sept. 16.
Liu was put into a mental hospital in June after efforts to persuade
him to quit the sect failed, and was released in July when his attitude
``took a turn for the better,'' Xinhua said. The writings of the Falun
Gong founder were found in the room with Liu's body, said a police
officer who confirmed the Xinhua account.
The Hong Kong-based information center said Tao Hongsheng, a 46-year-
old former policeman in Hebei province, died Sept. 20 after suffering
from diarrhea and other ailments. Sentenced to three years for
protesting in Tiananmen Square in December, Tao was held in a detention
center in Shijiazhuang, Hebei's capital, the group said.
Officials at the detention center were unavailable for comment.
Another sect follower, Shi Bei, died Sept. 10 after being put into a
mental hospital in eastern Hangzhou city. During three months there,
she was regularly denied food and given unspecified injections, the
center said.
An official at the mental hospital refused to comment on the report.

Most American's are not paying attention to the propaganda line of
Comrade Jigong and yet he insults 100% of American's. Just because some
court in New York city denounces the criminal behavior of the Chinese
governmant and its leadership, Jigong chooses to stereotype and insult
all Americans. Jigong is an unrepentant racist and running dog of a
corrupt Communist regime.
