Subject: Re: nutrisoft, nutrigenie, glycemic, diabetic, PSL

I am a representative of NutriSoft - NutriGenie. We normally don't try to
resolve business disputes in a public forum but this individual Bruce Ades
has used these newsgroups to post deliberately false information regarding
our business and his communication with us and I must regrettably respond to
his accusation in public.
In early April, Mr Ades purchased our Total Nutrition software. On April 10,
he emailed us this message:

I just paid for the full program.  Not happy with two major items, two small
ones.
1. Grams - can enter whole gms only, body weight, multiples of 5 lbs only,
age - 2 year increments only, etc.
2. Very inefficient search of food groups to enter meal items
3. No context help for mouse pointer when pointing at menu bar icons.
And so forth,
Please provide bug fixes or information on obtaining a refund.
Bruce A. Ades

We told him that our no-refund policy is clearly stated at our web site
http://users.aol.com/nutrigenie/order.html and also on the software mailer
we send out we affix a label saying that opened software is not returnable.
We also explained how to get the description for the menu bar icons by
clicking on the icon and holding down the mouse.
( Note: We have sample of our software at our web site for evaluation before
purchasing, so all of the software's capabilities and limitations are known
to potential buyers. This is our only email message to Ades regarding this
matter. )
Bruce Ades's reply by email to us on the same day:

Understood.
Clearly, a program that does not live up to its 'billing'. I'll be posting
my thoughts to DejaNews...

Bruce Ades then posted unsubstantiated and mallicious statements about us on
some newsgroups.
We've been in business for over 6 years with users in over 50 countries now.
Of course we were sad to see blatant lie posted about our products but we'd
rather let the programs speak for themselves with regard to their quality
and usefulness.
Apparently our software was articulate enough that on June 15, Mr Ades
emailed us an order for a second NutriGenie program Glycemic Index Diet Meal
Planner:

I'd like to order, by e-mail, 1 copy of Glycemic Index v 4.8

We sent him a reply (our second of the only 2 email messages to him) after
thinking about the matter for a day and this is the complete text of our
reply to his renewed interest in our software:
<<
Thank you for your message. We are unable to accept your order at this time,
however.
Sincerely,
NutriSoft

Because of our refusal to sell our software to him, Bruce Ades again resorts
to the practice of badmouthing our software on the Usenet newsgroups. Mr
Ades, please explain to everyone why you wanted to buy our software AGAIN if
it's really as terrible as you wrote. You exhorted others regarding their
right not to buy our software. Understood! But we also have the right NOT to
sell our software to YOU.
