MCKINNEY — Page Price and Carolyn Compton have been together for almost
three years, but a Collin County judge is forcing them apart.
Judge John Roach Jr., a Republican who presides over the 296th District
Court, enforced the “morality clause” in Compton’s divorce papers on
Tuesday, May 7. Under the clause, someone who has a “dating or intimate
relationship” with the person or is not related “by blood or marriage” is
not allowed after 9 p.m. when the children are present. Price was given
30 days to move out of the home because the children live with the couple.
Price posted about the judge’s ruling on Facebook last week, writing that
the judge placed the clause in the divorce papers because he didn’t like
Compton’s “lifestyle.”
“Our children are all happy and well adjusted. By his enforcement, being
that we cannot marry in this state, I have been ordered to move out of my
home,” Price wrote.
Price also mentions that Compton’s ex-husband rarely sees their two
children and was once charged with stalking Compton. She said he also
hired a private investigator in order to bring the case before the judge.
Court records show the ex-husband, Joshua Compton, was charged with third-
degree felony stalking in 2011 but pleaded to a misdemeanor charge of
criminal trespassing.
Price declined an interview until her lawyers figure out the next step.
Compton was granted a divorce from her ex in 2011, according to court
records. The case was reopened in April to dispute custody, which she
shares with him.
Compton’s attorney, Barrett Stern, didn’t return a phone call seeking
comment. Her ex-husband’s attorney, Paul Key, also didn’t return a phone
call.
Ken Upton Jr., senior staff attorney for Lambda Legal’s Dallas office,
said he is familiar with the case. He said morality clauses are rarely
enforced and were historically used to prevent unmarried people from
cohabitating with children present. Courts often include the clauses
without people knowing, especially in conservative areas like Collin
County, he said.
Gay couples are unfairly targeted under the clause because they can’t
legally marry in Texas, Upton said.
So, an ex who is upset that his marriage ended because his wife was gay
could use it against her later.
“What the clause has become is an extra burden on gay people because
they’re no more likely to violate it than straight people,” he said.
“It’s a problem that continues with homophobia.”
Upton said Compton wasn’t held in contempt for living with Price, but the
judge is going to issue a new order that cites Price must move out under
the clause.
The couple can appeal the decision, which would likely be overturned.
Upton said many appeals courts look at the relationship and if it causes
any harm to the children in deciding whether to honor the morality
clause. Being that the couple already lives together with a healthy
environment for the kids, Upton said they stand a good chance to win on
appeal.
If the couple decides to appeal, he said the case could set an example in
Texas for how courts will interpret the clause for gay couples.
“This could be an important case in Texas,” he said. “I think it’s a case
to watch.”
The situation is similar to a 2011 Houston case where a judge ruled that
William Flowers couldn’t leave his children alone with his partner, Jim
Evans, because they were not related by blood or adoption, despite the
couple being married. Had he ruled under the morality clause, the partner
would have had to move out.
The appeal was filed in October 2011 with the oral arguments heard in
November 2012, according to court records. The ruling is still pending.

This ruling will fall on appeal, and I tend to think that it should. The
state has no business dictating who and when an adult sleeps with, or
has sex with. That does not change the fact that the Lambda attorney is
dead wrong in describing a situation in which the children are watching
their mom have an lesbian affair with another woman, as "healthy". Such
is not the case, and will never be the case.

I do believe however that this lesbian relationship is probably no more
toxic to the children than many of the "traditional marriage" families a
lot of children are inflicted with.

Texas' economy is in decline, whereas California's is showing a dramatic
improvement now that we've overthrown the Republicans. Texas has lower
unemployment, but much lower average wage and a fair higher rate of
working poor.

Texas is the WORST state in the Union---at 28.8% of all residents---who have
no health insurance.

The national average is 16.9%.

In Massachusetts, which is the best in the nation, it is 4.5%. That state
has ROMNEYcare.

The latest figures I have been able to find are from 2011 and that year
the US economy grew by 1.5% while California grew by 2.0% and Texas grew
by 3.3%.

Unfortunately that same piece shows that Mississippi's GDP shrank by 0.8%

Mississippi is just plain unfortunate each and every year. Maybe if
it stopped getting government handouts, it could finally pick itself
up by the bootstraps and actually get to the real work of pumping up
their economy all by themselves - ya think? Personally, I think the

Yet Massachusetts' population grew by a meager 0.99% while Texas'
population expanded at a robust 3.63%. Granted, I have no idea how much
of that growth is due to birth and how much is by immigration, but it
does not seem as if people are flooding to the states that supposedly
have a better quality of life.

Quality of life is very subjective, and many of us would rather the
government stay out of our lives, which is why we do not live in
socialist hellholes like California.

Fair enough, since those are the most recent figures available, but I
would guess California's show a dramatic increase for 2012 and more so
for 2013 1st quarter. Just the increase in state revenues in 2012, above
and beyond those expected from the tax increases, indicate a big uptick
in economic activity.

On January 26th a pictured, snapped by public transit commuter Mike
Schmitz, showcases a Toronto Transit Commission (TTC) employee texting
on his cell phone while operating a bus. In the picture (shown below),

In Ontario, there is a ban on the use of mobile phones while driving.

iPods. The ban also encompasses being distracted by looking at any
electronic display that is not related to driving, such as laptops and
iPads.

The TTC driver has not been fined by police under this strict zero
tolerance law, raising some question among commuters if TTC employees
are above the law because of their extremely powerful union. The union
has stated that legal matters are in the hands of the police, but
they�ll support their members as much as possible. Currently, the driver
has not been fined, but has reportedly been fired, however this has not
been officially confirmed.

The driver in question has also been reported to have been driving with
his forearms as he was trying to text; however no picture was taken of
this. Since this original picture made its appearance on media outlets,
several more have surfaced of another driver texting while driving and
one even reading a novel while at the wheel.



These pictures have come to light during one of the deadliest months for
the TTC, adding to the already spicy public relations crisis the public
service is experiencing. 17 commuters were injured on December 16 when a
TTC streetcar collided with a greyhound bus. On December 23, an
electrical worked was stuck and killed by a TTC bus. On Jan 11th a
pedestrian was struck and passed away after being dragged blocks by a
streetcar. On both January 21st, and 29th, two separate pedestrians were
struck and killed by a TTC vehicle. And more recently a teenage
pedestrian was stuck by a TTC bus on February 1st. Whether distracted
TTC drivers are behind these accidents remains unknown, but it certainly
does not look favorable in any situation. These accidents, on top of
rising fares, constant disruption in service and other employee issues
(taking long breaks) has created a public relations nightmare for the TTC.

Len Gratto, an elderly citizen of Mission, British Columbia, has
recently felt the wrath of local city officials acting on an outrageous law.

Under current municipal laws in British Columbia, officials are allowed
to enter one�s household under the premise that the homeowner exhibits
suspicious �residual evidence� of illegally growing marijuana. According
to the grow-op bylaw programs used to search properties, occurrences
such as, soil or high mold counts constitute �residual evidence�. There
are a variety of fines and potential jail time attached with growing
marijuana in your basement, however even if no pot is found, municipal
regulators are still able to levy fines against you! The fact that
there is no requirement that inspectors find actual evidence of
marijuana has led to many issues.

This is exactly what happened to Len Gratto. He claims he was growing
cucumbers in his basement because they wouldn�t successfully take
outside. As a result Mr. Gratto was levied with a $5200 fine, even
though all he was doing was growing cucumbers, which is a perfectly
legal activity. Several other residents of the area have also
experienced wrongful targeting and fines by city officials. Stacy
Gowanlock was ordered to pay approximately $10,000 in fees and repair
orders because investigators found �dirt� in her basement, which is
classified as �residual evidence� of an illegal grow-op. At least half
of those inspected are deemed innocent, yet they still end up having to
pay the fines. On top of the absurd fees, victims also suffer from
impacted reputations resulting from the embarrassment of explaining to
their neighbours why their homes were raided.

As a result of this ridiculous law and wrongful targeting, Gratto,
Gowanlock and other residents have filed a class-action lawsuit against
the city stating that the law is in violation of their citizen rights.
Many residents label the entire process as a scam and support its
elimination.
