The original case appears to be an example of police using their intuitions
in a high-profile case, then making up evidence to fit. Something like that
happened in the Morin case, and in the Susan Nelles case many years ago (the
Nelles case never got to trial, as I recall). Police, prosecutors, and
judges appear to be thick as thieves, as in the Morin case, where they got
together to overturn the original acquittal, and instruct the next judge on
impaneling and directing the jury.
Baltovich has been out of prison since 2000, and I think that since then
they've been obstructing and delaying because they don't want anything to do
with Bernardo, for fear of what will happen (videotapes of important people
with Bernardo? Or corruption and incompetence in forensics?). The evidence
against Bernardo only amounts to a case for police investigation, but the
mere act of investigating might turn over a lot of rocks.
So I guess my hypothesis is that up to the late 90's the Bernardo factor
wasn't the main thing, but once Baltovich was out of prison lots of
officials just wanted it all to go away. Their consciences work, but not
very well.
