the State officials approved the construction and
inspected the building process at several stages.
The builder was required to have state issued
building permits and the contractors licenced
qualified workers.
It is apparent the hardworking buyers were bilked
by the misrepresentation of the sales staff and the
state inspection and approval of residential construction
process.. as well as the builders who profited by
sale of these properties. Surely they have a responsibility
to give the buyers fair value and safe living conditions.
Caveat emptor.
Here again the politicians have failed to protect
the taxpayer.

John, I can appreciate your concern for the poor citizens of Wood
Valley. Certainly their predicament is dire and worthy of concern. It
is human nature to want to find a scapegoat for one's problems,
however, I don't think anyone can place blame on the capricious whim
of Pele. How could the developers or anyone else have known the
future regarding the vog issue. Kilauea could stop flowing tomorrow
and not flow again for 30 years or, it could continue to erupt for the
next 100 years. No one knows. Should they be liable for a change in
the wind? Should they be liable for tectonic motion? I think not.
This is an unfortunate act of nature that is nobody's fault. Taxes
and public safety oave nothing or little to do with it. We're dealing
with forces here that are beyond the reach of our puny human control.
Superstitions about the old ways notwithstanding, perhaps the good
people of Wood Valley should consider making an offering to Hi'iaka,
the sister of Pele and goddess of the sea, who is the only one who can
quench Pele's fire. It might be worth a try. Bad news: I don't think
you can sue Pele for damages. Has anybody ever tried that before? I
wonder. Wouldn't it be a hoot if, come to find out, this whole
eruption cycle the past 20 years has happened because some tourist
from Minnetonka took home a rock? Maybe the people of Wood Valley
could sue that person.

Well, perhaps I was less than clear and precise in my response to John. It
is not against the likes of Pele or of that tourist that John should file
lawsuits on behalf of the good people of Wood Valley. Rather, it is that
set of folks against whom John rails -

- those are the folks against whom John should file lawsuits on behalf of
the good people of Wood Valley, concerned as he is of their plight. After
all, neither Pele nor that tourist has never even been mentioned by John.
And he certainly should not overlook opening his own personal home to them,
concerned as he is over their situation..
