Without getting into the politics of it, curious to see what chance
this has. The main argument appears to be that since Congress has not
officially declared war, the provision enabling the army to forcibly
extend a soldier's contract is illegal.

I seriously doubt the guy has a valid case, after all the country
needs maximum flexibility to call up troops to defend the county. But
that said, what is legal isn't always what is prudent! It's quite
foolish of the Bush administration to bleed the Armed Services dry in
this manner -- it guts the viability of the all volunteer service....

Anybody can sue anybody. The question however is whether or not a
judge will allow the suit to go forward. Not likely IMO...
