US soldier sues over Iraq call-up

A veteran US soldier is suing the Defence Department over its plans to
forcibly extend his reservist's contract and send him to Iraq.

Without getting into the politics of it, curious to see what chance
this has. The main argument appears to be that since Congress has not
officially declared war, the provision enabling the army to forcibly
extend a soldier's contract is illegal.

foolish of the Bush administration to bleed the Armed Services dry in

It should even be more interesting to see how they are able to sue the
Defence Department. It ust be one they slipped in on us while we slept one
night. Another sneaky approval by the Clinton Administration.

Anybody can sue anybody. The question however is whether or not a
judge will allow the suit to go forward. Not likely IMO...
