BRIEF IN SUPPORT OF PLAINTIFF"S ALLEGATIONS
The Plaintiff respectfully submits the following in support of the
Plaintiff's allegations against the Defendants.
I
Exhibit A consists of email defamatory against the Plaintiff that was
sent to one of the Plaintiff's enemies (who had been repeatedly email
harassing the Plaintiff) by Defendant Mikusko and then published on
usenet by that individual. This establishes conspiracy between the
Defendant and that individual regarding the Plaintiff and the (admitted)
cancelling of the Plaintiff's account.
II
Exhibit B consists of an email defamatory against the Plaintiff that was
sent to one of the Plaintiff's enemies by Defendant Scheirer and then
published on usenet by that individual establishing conspiracy between
the Defendant and him..
III
Exhibit C consists of several usenet articles published from Concentric
Network in a usenet newsgroup established for the publishing of binary
encoded child pornography named alt.binaries.pictures.erotica.children,
proving that it is a newsgroup provided by Concentric Network for its
customers to access.
IV
Exhibit D consists of one of the plethora of pornographic photos
published in alt.binaries.pictures.erotica.children (the same newsgroup
established by Exhibit C to be a newsgroup carried and propagated by
Concentric Network). This exhibit is a printout of a photo published
6/19/96 as "BABY RAPE, SECOND BATCH IN COLOR NOW bbr2-49.jpg". It is a
color photograph of an adult and a very young child in a sexual encounter.

Exhibit E consists of some usenet articles published from Concentric
Network in a usenet newsgroup established for the publishing of binary
encoded child pornography named alt.sex.incest (proving that it is a
newsgroup provided by Concentric Network for its customers to access).

Exhibit F consists of one of the plethora of child pornographic photos
published in alt.sex.incest (the same newsgroup established by Exhibit E
to be a newsgroup carried and propagated by Concentric Network). This
exhibit is a printout of a photo published 6/21/96 in a collection as
"Lolita#1 .Zip". It is a color photograph of a adult woman and a very
young female child in a sexual encounter.

Exhibit G consists of some usenet articles published from Concentric
Network in a usenet newsgroup established for the publishing of binary
encoded graphic bestiality pornography named
alt.binaries.pictures.erotica.bestiality, proving that it is a newsgroup
provided by Concentric Network for its customers to access.
VIII
Exhibit H consists of one of the plethora of pornographic photos
published in alt.binaries.pictures.erotica.bestiality (the same
newsgroup established by Exhibit G to be a newsgroup carried and
propagated by Concentric Network). This exhibit is a printout of a photo
published 7/2/96 as "dgslover.jpg". It is a full color photograph of a
adult woman performing oral sex on a dog. The news-group also contains
movies and outrageously perverse photos and movies.
These are just tiny samples of the volumes of graphic child pornography
carried and republished by the Defendants on their local news spool for
their customers while declaring that the Plaintiff was a net abuser" for
publishing unpopular Bible messages and an occasional ad for his
computer related products in computer related newsgroups. Since I have
also apparently documented criminal activity in my investigations
related to this civil matter, I do also send a copy this brief related
to the FBI as a matter of civic duty.

Your Brief has the attitude of a driver caught for exceeding the posted
speed limit who complains to the law enforcement officer that they aren't
catching murderers, rapists, molesters, & drug dealers instead of stopping
them for a frivolous ticket even while others are speeding by as they speak.
As a matter of civic duty, people who obey the Law would simply call the
Police/FBI and inform them of the activity. But as you have hinted, the
lawsuit was about your alleged violation of rules, not others who violated
rules. And, you were hoping to be paid $80,000 for your efforts. So, you
didn't just merely report it as your civic duty. You were hoping to profit
from it.
Why were your Bible studies unpopular? Were they inappropriate to the
occasion? What has gotten you into trouble in the past is you make personal
character assassinations and then follow it up with a lesson on Biblical
salvation as if this is supposed to prove something. In itself, it's
irrelevant
to your topic. Therefore, it's inappropriate and would be
unpopular. Ah, but it leaves the door open for you to claim that people

It's because you keep making character assassinations against him and
he's showing the bottom line is the real Christian preacher from Durham is

activity. What's interesting is Mr. Adams has posted a brief history about
himself and how he came into Christianity. He doesn't describe himself as

Does that mean an attorney or Pro se plaintiff has the right to brake
the law to "collect" evidence". For example, one you sort of used,
could an attorney go to a drug dealer purchase or steal drugs then
submit those drugs in a civil court as "evidence". I dont think so. You
can investigate but not do anything that any other citizen could do. I
mean if you called the police, they collected the evidence, then you
obtained it through legal channels then that would have been fine. At
least that is my opinion. I wonder if any of the fine legal minds would

If the e-mail Rod posted gives us an accurate glimpse regarding Mr.
Winter's general attitude, he isn't here to engage Bible anything in an
honest atmosphere. I'm not surprised he resorts to curses because in the
long run, his bad atttitude is all he really has to offer and he has to
defend that somehow. Is he wrong all the time? No. But, he has shown on
many occasions he's definitely out for himself and those who put him on a
pedestal. As for the rest of us, we can go to Hell for all he cares.

The [10-1] brief was the one in which Steve Winter submitted the child
pornography and animal bestiality photographs. Steve apparently filed a
motion to dismiss and strike it at a later date. I wonder why?

My guess is a realization that his evidence could do more to hurt him
than help him. In the long run, it's existence likely reflected what has
seemingly plagued him with Internet relations in the first place: Mr. Winter
isn't above circumventing rules of ethics to achieve his own ends.

In one sense they were a victim of the scum like Adams and other
filth who were part of the conspiracy to send the organized
campaign of frivolous complaints to have me censored because
they can't defend their filthy false-christianity in an open
forum.
Yes, the defendants made a very very bad and very very expensive
mistake, but there comes a point where justice is served. I did
what I did out of self defense and it put a stop to my accounts
being cancelled without cause once they knew I wasn't bluffing.
It also removed their ability to claim that they did not regulate
USENET and I believe led to some very bad, illegal content USENET
groups disappearing.

Therefore, the truth is an absolute defense against an accusation of libel.
Firstly, I said you were in possession of child pornography. You called
that "malicious libel" and a lie. I posted your own brief to the court
which proved you had child pornography in your possession. You were
caught lying. No "malicious libel", just the truth.
Secondly, I said you broke the law by possessing child pornography. You
called that "malicious libel". I then posted the federal statutes
pertaining to possessing and transporting child pornography. You
violated those statutes. Again, no "malicious libel", just the truth.

This reveals that your belief that you did nothing illegal is partially
based upon your not having been told what you did was illegal. This is
like believing that since I sped past 6 different cops, and none stopped
me for speeding, then the logical conclusion would be that speeding is
not a violation of the law.
Then suppose a 7th cop stopped me and cited me for speeding. Why, I'd
haul that cop into court and charge him with malicious libel because six
other cops never told me I was violating the law, therefore I wasn't.

And this is another of your mistaken beliefs, Steve. No "agent of the
court" is permitted to commit illegal acts, such as downloading,
viewing, printing, possessing, and transporting child pornography.
If agents of the courts were allowed to break the law in collecting
"evidence", believe me, lawyers would be doing it all the time. However,
as the rest of us know, evidence gets thrown out of court all the time
because the law was broken in obtaining it. Lawyers also get sanctioned
by the court, and disbarred.

The only way they would suffer is substantial civil fines and/or hiring
additional staff to police their networks. Otherwise, it would only require
a few minutes to remove undesirable groups from their servers which could be
part of routine maintenance.
Once a Senator gets involved and initiates a congressional hearing about
their activities, ISP's will come under their jurisdiction, not just
Concentric.

Maybe it's just me, but you're difficult to engage in a meaningful
discussion in an open forum. I've compared your site to Mr. Adams and he
comes across as more eloquent and talks about his Christian life a bit.
Because you have engaged him on several Christian issues, he took the
liberty to dissect some of your sermons. I hate to say it, but he comes
across as more believable in some cases. We can discuss this further if you

unpunished while they get their fingers slapped for disobedience because

There are a number of considerations on that philosophy as Concentric
didn't cancel your account by drawing your name from a hat. Proactive
management is setting up guidelines. Reactive management is enforcing them.
What made your case all the more difficult is allegations that you were a
bad boy. It appears you were unable to prove otherwise. Why is that?
1. Concentric wasn't directly responsible to police its users.
i. there is a savings of administrative costs;
ii. if everyone behaves, why would they need policing?
2. They had the legal right to deal with those who refused to abide by
their TOS.
Eventually, someone will abuse their freedoms and go too far. When
that someone is brought to their attention, they use reactive management.
It's like judges; sometimes they use a feather, sometimes they use a mallet.
The issue that refuses to go away for you is just why you chose child
pornography as a vehicle and how you set about acquiring it. Anyway, have a
