I am not a lawyer, but from what I read above it would seem that if the
value of the pirated?? software is over $2500 it is a felony.

If it is over $1000 it is a misdemeanor.

If it is less than $1000 it must not be a criminal offence then.

ALS sells cd's with about 600 pics on them for $40.00. If someone were to
post 600 pics then they would be guilty of pirating $40.00 worth of
software. To reach $1000 they would have to post about 18,000 pics.

Guys, guys, guys. DON'T WORRY!

They haven't got the balls to see this actually get in front of a
judge. It's ALL a big bluff.

If ALex ever got in front of a judge (and the defendant wasn't a
complete moron) he KNOWS damned well that defense evidence is going to
include the colourful history of ALSscans Inc.

Ya know, like when they used to post kiddie porn and when they used to
publish someone else's copyrighted images themselves from European sex
mags.

If ALS *could* actually get a court judgement against someone for
posting on the newsgroups, don't you think they'd parade that example
around in front of everybody? Nope, never have and never will. Kirn
could end up going to jail himself. You think he;'s gonna risk that
for a long shot (at best) at a favorable judgement??

Best they can do is make a copy of something their lawyer sent
somebody and that means absolutely nothing in reality.

Who would win in court, a non-profit copyright violator or a
for-profit copyright violator/child pornographer?

So not only is ALS all bark and no bite, they're also utter
hypocrites.

And as always, I post from my real email address and make no secret of
who I am.

And ALex, KNOCK IT OFF, quit threatening people. Learn to live with
what you created, be grateful anyone posts your scans at all, it's
free advertising. And oh yeah, your silence is *deafening*.

your pal,
The *MIGHTY* (yet modest) Two Tub Man

i'm not a lawyer either, but the letter specifically stated film clips

site is a doorway to the als site, so I think that we are getting
snookered here and I cannot figure the reason. just an opinion
but i am an opinionated guy...

You are obviously NOT an attorney. The intrinsic value per image is
$1500.00. 2 images and it is a Felooy. Have doubts. Ask an
attorney.

well, they're good, but not that good!!!! get real, how can a jpeg have an
intrinsic value of $1500.00 Anything is only ever worth, what somebody is
prepared to pay for it. I'd suggest, an intrinsic value for an als jpeg is
the price it cost somebody to buy a cd, or access to the website so they can
download it...

Hey ALS, if you'd ever had any particle of success in court, you'd be
telling us about it instead of making idle threats. Get lost.

My only thought would be they are including the costs of paying the
models, paying for the place to do the shoot, costs of
photographers/equipment, etc. Still seems kind of steep.

Bwwaaa-haa-haa-haa!!!!! This is too funny.
Someone claiming to be a representative of ALSSCAN who CAN'T
EVEN SPELL "FELONY" or put a "?" where it belongs claims that an
image of Paige shoving her fist up her twat is worth $1500!!!!! Hold on,
I can't see the screen!!! The tears of laughter are clouding my vision.

*ahem*

Let's break this down for this poor, misguided fool. If one ALS picture
is worth $1500 (giggle snort- sorry, laughter breaking through), then that
means that one of these posters who's got, oh, say 4000 ALSSCAN
images on his/her hard drive has got SIX MILLION DOLLARS on his
hands!

HEY Zed! Bl00by! You should call yourself the six million dollar men!!!
Someone who obviously doesn't have anything to do with ALSSCAN is
claiming that you've got a fortune on you machine! (albeit an illegal one,
or so they keep saying) The posters in this group must be Public Enemy
Number One!

--- Or someone (I won't point any fingers at a...@clark.net ) is out of their mind.
Remember when they claimed to have shot 2500 pictures of Jana? They paid
her a couple of thousand dollars for the shoot (simple math renders about
$1.00 per picture plus the cost of film and processing) and they walked away
with $3,750,000 in intellectual property!

Damn, you guys need to start paying these girls more.

Wow!!! I think the girls should file a lawsuit against them for armed
robbery(the weapon being the camera). For the small amount they get paid for
so many photos, it is almost SLAVERY and I thought SLAVERY was illegal in
the States.

I think if anyone has one of the girl's E-mail they should warn them of the
real value(1,500.00$/picture) of their work!

What's a "felooy", never heard this one before (hehehe). Oh, and "Have

Considering they average 200 used CD pics a shoot and who knows how many
outtakes, bonuses etc and they pay on average 2000 a shoot to the model
I seriously doubt it costs more than 1000 a picture but intrinsic value
is not wht one person is willing to pay. It's what they could make of
of the picture total with all potential sales. It would be calculated
based on what ALS lost because of your posting.

This msg is a fake. There is a group of trollers who pride themselves in
creating this type of msg. These are the same characters who posted the
previous msg's dealing with this subject. I ran across a thread in one of the
hack ng where they were awarding themselves on the havoc they were creating in
various newsgroups. A number of posters were being acknowledged for their
ingenuity and commitments were made to be more creative in their efforts to
creating turmoile in the binarie ng. They seemed to take special enjoyment in
posting fake copywright scares.

Well, to all of you who are arguing back and forth on the legality of this,
I am the one who is catching the brunt of the Bull Shit. When I dialed up
the phone number for the attorney they listed, it went to an actual
attorney. I have been digging into the background of ALS though and as was
stated in previous posting all has been true. The way they started and all,
though at the time I didn't realize that these were true. When they first
started these terrorist tactics I made the links in my web site point to
them. Well follow them and see what we can find now............ :)

In article <34F36A...@hotmail.com>, razam...@hotmail.com says...
Aside from what everyone else is griping about, a copyright cannot be
enforeced if the image doesn't say its copywritten. Many of the older
postings in the "fisting" group did not state that they were
coppywritten. Furthermore, many of their images showed fisting, which
is up there with "child-pronography". If ALS so desires to enforce
copyright violations, they may very well end up in jail for posting
illegal pornography in the United States.
