Follow up on my situation with hardwood floors upstairs

I have posted about this a few times... After 4 years, and me finally hiring a lawyer. They are NOW fixing the floors above.. It sadly took me needing to pay for a lawyer too not only get the HOA to step up, but also the people above to stop playing games.. They installed hardwood floors them self in 2009. The owner mentioned this to me a few years back. However, I learned a very good lesson. Our Hoa is worthless and they refused to follow the CC&R's when it doesn't benefit them. This entire situation was handled so poorly and became a joke to everyone. I suffered for years and the HOA refused to fix the problem.

Lesson learned.. As sad as this sounds, we really can do what ever we want and not respect others if we choose because the HOA will not do anything about it.

I'm sorry to hear about your 4 year battle.  I remember some of your posts in the past and I'm glad to hear that things are moving along in your favor.  Was the lawyer used for the tenant upstairs or towards the HOA?  It seems HOA is quick to send warning letters and send you to disciplinary meetings but I have yet to hear of people getting hit with lien's or restricted amenity usage.

I'm curious though - was it noticeably louder for your neighbor to have wood floors than the noise you would hear with carpeting.  I always thought cork + wood floor is more sound proof than carpet pad + carpet.

Was the lawyer used for the tenant upstairs or towards the HOA? Both, we were going after both by the end. at first we tried to have the Hoa work with us. That didn't work very well. I did have Their lawyers ask us to hold off on going to court also! Then, tried to justify a bogus reason?

It seems HOA is quick to send warning letters and send you to disciplinary meetings but I have yet to hear of people getting hit with lien's or restricted amenity usage.-From what Ron told both me and my lawyer they won't send people to court because it messes up the sales process for the whole complex. So they won't do anything. I think they are trying to find a better way to fix it but hello, the owners above moved out and they dismissed all the fees and didn't disclose the hardwood floors to the new owners.

If he did it right, I wouldn't have had as many issues.. But, the guy upstairs came home ever night around 2:30 am and I was woken up nightly and couldn't go back to sleep until he did.. At 6:00 am the girlfriend would wake up for work.

It is good to know that justice does prevail!  How sad it had to go to that, though!  Congrats on your big win despite a lot of heartache, I am sure.

Can you provide the name of your attorney? I am having the same issue and would like to go this route.
