Dear Friends @ Hum Janenge,

Greetings!!

I am using this forum for the first time to seek help & guidance from all of you for a small issue that touches the lives of around 450 Families in a small but growing town called Thane in Maharashtra.

We live in housing complex of 13 buildings in the outskirts of Thane city near Upvan Lake. For approximately 3500 residents & adjoining settlements/gaonthan, we do not have a designated park or an open designated space.

We have an open space surrounded by our buildings designated as "Land for Displaced" with an area of around 3000 Sq. Meters in government records. This space has been slowly encroached by local shanties & a local builder has kept his men on the land.

However major portion of the land is still open & we want to use this as public play ground or convert it into a park for which the apex body is ready to contribute. Currently we are maintaining the remaining open space as a small ground.

I want to know:

1. How can we get rid of the encroachment using the RTI?

2. Can we use RTI to convert the reservation on the land from Resettlement for Displaced to Green Zone?

3. How can we force the local body which is Thane Municipal Council to atleast clear whatever is available & create a boundary around the space?

RTI is only a tool and not the pancea for your Problems all the 3 questions or problems you are seeking has to be resolved in certain higher forums after meticuluos collection of Documents through RTI

Dear Rajesh A Pandey,

Get a copy of the Town Country Planning Act of your State.

Get copy of Muncipality Act applicable to your town.

Then proceed with those acts.

RTI is meant only to get info n not for action,after getting the info about the land than u can take up the case for converting it to the use u want for ie (change of use of land) if so required from the municipality / town planning office.

2) If a site is shown as "land for dispossessed" then ought it not to be used for that purpose ?

3) Town Planning is a holistic multi-layer heirarchial process. Myopic interference by ignorant people is the bane of professional planners with decades of experience and all the qualifications to match.

1. How can we get rid of the encroachment using the RTI?

Please write a letter/petition to Thane Municipal Council along with photographic and video graphic evidence of encroachment supported by statements of at least two eye witness and if possible secretary and chairman of each society buildings.
Then follow it up vigorously through RTI to know what action has been taken by Municipal Authorities to evacuate the illegal encroachment.


2. Can we use RTI to convert the reservation on the land from Resettlement for Displaced to Green Zone?

You may ask through RTI to know the norms for converting land reserved for displaced to Green Zone. Once you know the norms and if you feel you can abide by those norms then again write a letter/petition and follow it up through RTI.


3. How can we force the local body which is Thane Municipal Council to atleast clear whatever is available & create a boundary around the space?

Its a criminal offence to encroach upon Govt. Land. With all supporting proofs of encroachment make a petition praying that it is in the larger public interest that Thane Municipal Council must clear or create a boundary around the space. Again follow up the Petition through RTI to know what steps the Municipal council has taken.

Mr. Roy have you ever visited Thane suburbs? Do you know what is a housing society?? Do you know how encroachment happens in Thane and Mumbai by unscrupulous Builders?

I am sure enough that without appreciating facts, situations and without even applying your brain you suggested the below points to Mr. Pandey to which I am answering:

1) Why are you trying to selfishly impose your middle class views on a statutory planning process ?

Mr. Pandey is trying to save a piece of Govt. Land which is slowly being encroached by unscrupulous builders.
Now how Mr. Pandey is trying to selfishly imposing his middle class views on a statutory planning process? He wants to use RTI in a larger public interest.

2) If a site is shown as "land for dispossessed" then ought it not to be used for that purpose ?

How and why you have assumed or presumed that if the land has marked for dispossed has to be used for that purpose even though lakhs of people will live without any greenery or park because the stupid statutory planning process happened hand in gloves with the builder?

3) Town Planning is a holistic multi-layer heirarchial process. Myopic interference by ignorant people is the bane of professional planners with decades of experience and all the qualifications to match.

These poetic words are devoid of any substance rather highlights your ignorance about the corruption that is happening in town planning process of Thane.


This is a member intervention cautioning you the Moderator from demoralizing members by jumping into conclusion without even knowing or appreciating facts and giving misleading suggestion .

There is nothing wrong in Mr Panday's query. All he is asking is a legitimate way of preventing the local builder from monopolizing the "land for displaced" govt tag. There is nothing selfish in this. People like Mr Panday should be given correct advice with due respect rather than be dubbed as selfish in a brazen manner which vitiates otherwise very cordial and well meaning intent of this wonderful Humjanenge forum. Long live true RTI activists.

Thanks for showing concern for saving the land from encroachment.  File another RTI, ask for the steps taken to prevent the encroachment.
Form a group of resident, send letter from top to high authorities, take help from media, ask for the personal meeting with authorities.  Other steps as suggested by resident in their collective wisdom.

Authorities generally cloes their eyes to such encroachment and it takes place such with the help of musslemen, property dealers and behind them, it is generally found some local politician having an eye on the votes of the encroachers in the next election politician plans to contest. Encraochers gets supports from local representatives.

You need to send a lawyer's Notice to the authorities and thereafter call newspaper jounalists and get it publicity. Involve the politicians and police, babus and whoever counts like the Zilla Sainik Board, Thane.

1) If you cared to research you would find that I have participated in many Urban Planning processes and ensured that my opinions have been taken into account, including by use of RTI.

2) If Mr Pandey wants to save Govt land from encroachers he does not need RTI to do so. He can very well register a FIR or inform a magistrate if he has specific information. RTI is a cowards way and is not an "alternate remedy" to address this problem. RTI is not a grievance redressal tool.

3) Mr Pandey's motives are very clear - he himself wants to encroach / usurp land meant for people disposssed to put up the very same apartment blocks he now stays in and convert it into a private.park / playground for the rich. Where will the disposses people go / stay ? India is now a SOCIALIST  republic and Mr Pandey would be well advised to respect the rights of his fellow citizens.

4) Insofar as the "stupid statutory planning process" is concerned. It is the stupid citizens who fail to properly utilise their statutory options who are half the cause. Having failed to use these chances it is pointless to go whining / whingeing on forums like ours.

5) The purpose of forums liek HJ / RTI4emp are to STRENGTHEN our members and train them to use Goivt processes properly. Govt can (and does) work if they are approached properly. It is CAs and CSs etc who have a vested interest in projecting that systems / processes are corrupt and that touts (like them) are required to get things managed.

Greetings!!

For all the time I have been following this group & have been a passive member, have seen & witnessed good amount of advices, views, opinions both constructive & otherwise as well.

I am of the view that, the expertise which groups like HJ have is tremendous & should be optimally utilised for the benefit of the group & the nation at large.

My query came out of a genuine challenge that the residents of Raunak Park & Patlipadha Gaothan both are facing jointly.

Here, it would be appropriate to update you that Raunak Park is a middle-higher middle class Resicomplex & Patlipadha Gaothan is the village that is in existence for hundred of years.

Residents of Raunak Park & of the Patlipadha Gaothan's original residents are both inconvenienced by this reservation.

Primarily it is the residents of the Gaothan who have been resisting the new people from outside trying to encroach upon the land parcel.

This change was brought about keeping the builders interest in mind who may want to buy out the village & construct buildings on the same & handout low cost, free land small flats to the villagers with the money for their land. Unfortunately this has not worked out with the interested Builder due to his offer price to villagers.

But, now that the villagers are not ready to sell their land & are rebuilding their own houses using their personal funds or funds provided by Microcredit SHGs working in the area, this open land is being encroached by people from outside. We got the builder's labourer camps on the ground cleared through TMC intervention Five years back.

What we want is to clear & demark the ground for kids to have a play ground or a Nana Naani Park which can be either maintained by TMC/Apex Body/ Coordination Committee.

It is not my personal interest & fortunately I am not so economically endowed that I may want to keep the land for myself to do something in future.

My objective is to get this wrong demarcation changed to necessary demarcation & for kids & us to have an open/green ground.

If that seems to be an attempt to show my middle class approach, I would rather have more of it.

If that is my personal agenda, I would for sure pursue it.

What I would urge you is to help us by giving us advice on a way ahead legally & a town planners perspective on how can we help all these people make these amendments.

Hope I have been able to appeal to all members for help too.

1. You might have participated in many urban planning processes but you do not have an iota of experience in the planning process of Thane or Mumbai.

2. I am now confident that you do not have hand on experience with Police or at least registration of an FIR. If you differ with me then let me know how many FIRs have you filed till date? On what section/provisions Mr. Pandey will approach Police or Magistrate?
However Its the duty of Thane Municipal Authority to keep the space un- encroached. Mr. Pandey does not have any grievance, he is reminding Municipal Authority to do their jobs and asking them through RTI to know whether they are doing or planning to do something in the matter.

3. Mr. Pandey, as per you is having middle class mindset. But now suddenly as per below mail becomes rich and wants to have a private park. May I know your age Mr. Roy to find out its your age or Anti Mr. Kejriwal and Team Anna factor which is distracting your focus? I pitty on you Mr. Roy when you say Mr. Pandey can encroach the land. Do you think its that easy to encroach a Govt. Land? The encroachers neither have an intention to hand it over to the dispossed nor to Municipal Authority, leave alone the development of Park or play ground which comes later. Can you tell me the intention and from where they are having the courage to encroach? Probably people like you never ever find out the reasons.

4. Point number 4 is a general statement and its not only applicable to stupid statutory planning process rather applicable to stupid drafting and passing of legislations in parliament. People like you become Activist overnight due to such legislations having loose ends. And when the whole Parliament resolves something due to some true, dedicated activists you having failed to use those chances of becoming a part of history starts whining / whingeing on forums like yours. Even claiming that they have DERIVED information from IB. Whom are you fooling Mr. Roy?

5. Regarding point no. 5 you are trying to STRENGTHEN your members and train them to use Govt processes properly. Don't you think Mr. Pandey is trying to learn the same from you the so called ACTIVIST and to use RTI to remind Govt. to do their bit.

6. The statement " It is CAs and CSs etc who have a vested interest in projecting that systems / processes are corrupt and that touts (like them) are required to get things managed" is a mere allegation and shows your lack of knowledge as to where CAs and CSs are from. If you cared to research you would have found that they are a part of statutory bodies under the acts of parliament, role and responsibility defined. Its the people like you should have come to us for a training before Strengthening your members ( read as giving useless opinions) on RTI and its use\misuse.

Mr. Roy if you have guts please arrange for a poll which is a democratic process of knowing how many members of YOURS support your views.

You can do it in a very limited way by RTI.RTI in no way can really help you in this. You need a trick to use RTI. RTI act is very much incomplete and to make it complete for working some ...tera... steps to be taken which are generally cannot be done in a straight forward way using RTI act.

dear according to my experience forst you & others resident lodge the
complaint to different related authority by regestered post.and after
one week you send RTI application on this complaint, like what action
on my & other complaint regarding this encroachment.who official
responsible for stop the encrochment.what action in this matter by
responsible official.
suggestion- RTI filed on this senstive matter by 2-3 diffrent person name.
