Subject: Trademark Scam?
Can anyone offer advise please is this a scam?
You may have seen this type of approach before:

Dear President,

I think you are misunderstanging .What the MingPeng Investment Limited
applied to register aren't your trademark or brand. They applied to
register it as the internet trademark "Countylimos", which  has no
prefix"www." and no postfix".com". The internet trademark is one of
domain name. For domain name takes open registration, the MingPeng
Investment Limited  has right to register it. As a domain name
registrar, we have no right to dispute their application. So we sent
email to inform your company to protect your interest. As the company
whose name relate to the applied domain names and Internet Brand, you
own the preferential rights to register the domain names.

If you think the application for these domain names and  the internet
trademark  "Countylimos" will not impact your business development or
think your company brand without any value and therefore do not intend
to protect these domain names on your own,we will pass the application
by our client after getting your confirmation and register for them.

But if your company have business in these country(China/Italy/Germany/
Hongkong.etc.),I advise you to make a careful consideration of this
matter. After all this concerns your IP rights.

Best Regards,

Brian Guo.

To reiterate

County Limos IS a registered trade mark
registered by us with UK Companies House
We have no interest in additional domain names for trading overseas
We do However OWN the trademark CountyLimos and any use of its name
would be in contravention of Companies House

Sorry just to add latest email update...

Dear President,

I think it is necessary to explain Internet trademark for you.
Internet trademark is the extention of trademark or brand into the
internet, which doesn't have a prefix or postfix. Registered
successfully,It will come with an electronic certificate issued by our
government, guaranteeing the exclusiveness of this registration and
future trouble in the future. In the meantime, when typing it in the IE
or a search engine,it can lead directly to your website.Besides,it can
be applied worldwide.

Hi Steve

As far as registering domain names is concerned, I'm afraid Companies
House can go and whistle, since they do not technically hold any kind
of jurisdiction internationally. As far as the UK is concerned, about
the only thing you have [without fighting people for it, in court if
necessary] is .ltd.uk, which is a domain extension only available to
Limited companies, and then only under their incorporated name.

But since you already own countylimos.com, and [at least as far as I'm
aware] this 'Internet Trademark' looks like yet another Chinese scam
playing on people's lack of knowledge, I'd consign the thing to where
it belongs; in the spam bin.

I wonder what the W3C has to say about this?

Cheers

Sasch

Thanks for your input Sasch.
I did do some searching prior to my post and Trade Mark Intellectual
Property
does seem a new yet grey area
W3C?

Is the scare tactic basically saying that when we purchased
countylimos.com it dosen't automatically give us the Intellectual
Property rights to
CountyLimos?
Or is it basically rubbish?

Yes... the scare tactic is that they're trying to sell you some bogus
global 'Internet Trademark' which doesn't hold any water anywhere, and
trying to scare you into making the registration by telling you that
some dodgy, non-existent Chinese mega-corporation is after it. But
hey, they're nice, cuddly Chinese guys, right? And they're in your
corner, right? And if you can't trust these nice cuddly Chinese people
looking out for your best interests who can you trust?

Sorry... I hope my sarcasm dripping all over the place doesn't damage
the group's architecture any more. ;-)

But yes... at a guess I'd say it's basically a load of old toot...

Thank you again for your input.

For what it's worth, I've gotten these emails too. The idea behind
them is generally to encourage you to register domain names which you
don't need with them. In other words, they tell you that someone is
trying to register say "johnmu.cn" but they offer you the chance to
get it first (for some inflated price).

I think your redirect is probably the best solution :). If you really
wanted to register CountyLimos.cn, you could probably get it for 17
cents or so from a normal registrar (I think that's still the current
first-year price :-)).

Thanks for that John.
It wasn't so much the domains as the slant on Trade Name ownership
that had me having to do research.
But thanks for your input.

The irony is that countries like China and Russia are notorious for
not respecting, nor protecting any private trademark or copyright
whatsoever, regardless of them being registered there or not. They
seem to subscribe to a wide open notion of "fair use" in general.

we have had a bitter and futile struggle with these scamsters for over
a year. They are based in Shanghai and they will register your
trademarked name under some obscure chinese TLD. Finding and
identifying the orginating source to sue or take action against has
been difficult.
One solution we found was to file a complaint here
http://reports.internic.net/cgi/registrars/problem-report.cgi  who can
impose various sanctions on nonresponsive registrars.
