Funny. They are providing Pay Per Click but since they charge a flat rate (which I am sure is based upon how much it cost to meet the PPC requirements to stay in the top 3 positions) and saying it is not PPC. I suppose it could be fraud since they are saying it is not Pay Per Click but it may skirt the fraud issue by charging a flat fee to the client. They are marketing to the naive and those who are unfamiliar with how SEM works. I am sure there a plenty of people out there who will fall for this though.

Hey?? PPC might increase you traffic, but I can tell you from experience that it doesn't change your serps.

Yeah, but if you notice the wording they never mention anything but the Top 3 Sponsored Results so in reality they are not promising good SERPs. The uninformed may infer that is what they mean but they cover themselves pretty well with the mention of sponsored results.

cipango, you are right but I would be willing to bet that simply having a dedicated account rep, which many SEM companies have, could cover them. I agree with you that it is fraudulent but they may be covered in technical terms.
