Has anyone renewed his M&S contract for Views this year?
I was just contacted by « MS/FAST »? accounting department regarding my own invoice dated early this year that I did not pay.
When I told them to just cancel it, I was answered that I was breaking my M&S contract with « MS/FAST »… Somehow they gave me the impression that the new owner will be going after « its » money. I told them to sue me…
It is quite insulting to be accused since 1. M&S was paid every year the past many years even though they failed on their part to even produce ONE upgrade every 12 months for their software; 2. if anyone did break any contract it was them when they announced unilaterally that they cancelled views; 3. I have been selling/using views since the early 1990’s. We have been FBP and OM whatever they called it then partner and then were unilaterally flushed when they decided to change their distribution pattern; 4. We are a Folio Publisher and views is a software we love dearly, but we are now forced to look for a replacement since it was discontinued unilaterally.
We have had all kinds of “titles” through the decades as well, since 1988,
when I first flew to Provo to see this software first hand.
(Although, I refused to take the test to become a “Certified Folio
Consultant”) I just sort of certified myself....
Was this call from the guys in Provo, or some other Micro$oft location?
And if from Provo, did you speak to someone outside the accounting dept. to
be very clear that this is the accepted path the company is going to pursue?
Is it possible that some new hire in the accounting dept. just doesn’t know
how M&S renewals work?

Jules, our accounting department was simply following up on an
invoice. Since it hadn't been paid and we hadn't heard from you, we
wanted to confirm your intention. This isn't a new onerous policy
started by our acquistion by Microsft; it's just good business
practice. I'm sure that you, as a business owner, follow up with your
customers to ensure payment.
Many of our customers are set up on an auto-renewal process for
Maintenance and Support. This process helps ensure that our customers
receive seamless M&S by (hopefully) preventing accidental lapses in
M&S. Standard contracts going back to the original Folio Corporation
provided for this. Those contracts also have a standard 60-day
notification requirement should you choose to not renew. This gives us
a chance to appropriately update our systems.
I am certain our accounting department did not "accuse" you. I am also
certain that we can find a way to work this out. It does get more
complicated once an invoice is issued, but it can still happen.
Please note that we continue to offer Maintenance and Support services
for the Folio and NXT products. Maintenance includes correcting
defects, delivering software patches. Support includes access to our
support staff, who continue to answer questions, provide work-arounds,
log defects where appropriate, and help our customers with deployment
and functionality questions.
If you have additional concerns, please bring them up with me
directly.

I don't remember when my M&S renewal comes up each year, until I get said
invoice. I don't recall ever getting an invoice for renewal sooner than 60
days before it was due.
Are you saying, if we wish to discontinue renewal of our M&S contract, that
all of us M&S customers are required to give you a 60 day notification in
advance of our M&S renewal date (and before receiving an invoice for such
renewal), or else we have broken our contract and that we will be liable for
the $$$$ due if we don't provide the 60 day advance notice?
Have you got any news that would give me incentive to renew my M&S again
next year? You know: news along the lines that Folio Technology will be around next
year? Currently, all I hear is that Micro$oft has cancelled all new sales
(must be hard to keep a cash flow for FIT like that) and that maybe it will
never come back,,,,,,,,,,,,,

We still working with FOLIO too. Our provider was DOTSA (in Argentina)
and they told us that It is probably FAST declare FOLIO will be
discontinued. I was finding information about it but I cant find
nothing related.
I think there is a large group of FOLIO Users around the world and we
still need it to produce our products.

OSLO, Oct 16 (Reuters) - The Norwegian police economic crimes unit said it had charged Microsoft-owned search technology firm Fast Search & Transfer with accounting fraud on Thursday.
"We are raiding Fast's offices now to secure evidence," police attorney Baard Thorsen said. "The charge is for accounting fraud."
Fast was acquired by Microsoft (MSFT.O: Quote, Profile, Research) for $1.2 billion in February.
"The charge regards accounts from before Microsoft came in," Thorsen said. "We think Fast recognised revenues that there is no basis for."
Fast was not immediately available for comment.
Norway's financial watchdog said in May it had reported possible violation of accounting rules by Fast to the economic crimes unit.
In June the watchdog said it would also probe the auditor of Fast, Deloitte & Touche DLTE.UL, for suspected irregularities in the computer group's accounts.
Fast is the world's second largest provider of enterprise search software that allows companies to comb internal corporate documents, data and other information, a market also targeted by Google (GOOG.O: Quote, Profile, Research).
Before Microsoft's buyout, Fast stock had tumbled after the company said in mid 2007 it would no longer recognise revenues from memorandums of understanding, and instead book revenue only from final deals.
The police and Norwegian Ministry of Justice are among Fast's customers in Norway.
I just read the last message about Norway Police and FAST.
I hope that situation won´t affect FOLIO customer around the world.
The worst thing can happen for me is that bind page will be not
available soon
because that means we are not available to publish FOLIO DVD ROMs.

I'm concerned about the statement you have made about the bind page not
being available. Is this a known fact?

Hi. Folio Users:
I just read the last message about Norway Police and FAST.
I hope that situation won´t affect FOLIO customer around the world.
The worst thing can happen for me is that bind page will be not
available soon
because that means we are not available to publish FOLIO DVD ROMs.

All:
The Bind page is working. Don't panic.
I have been told that this does not affect the US operation of
Microsoft/FAST/Folio.
It would be nice if Folio people in Provo could post something official
here. This is an issue that OUR CUSTOMERS have alerted us to....
We should have heard of it first, from Folio/FAST, in my humble opinion...

Please note that the Folio and NXT product lines continue to be
maintained and supported, as noted in earlier posts. The Folio Bind
site is still available and will remain so. Should you ever find the
Bind site to be unavailable, please contact our Support department so
we can correct the technical issues that could cause the site to be
down.
Microsoft, and its FAST subsidiary, continue to be focused on
innovation, providing value, and supporting our customers and partners
now and in the future.
If you have further questions about Folio or NXT, I am happy to
discuss them individually.

I have a received several messages asking for more clarification about
the investigation.
While we cannot comment on an open investigation, I am pleased to
repeat FAST’s commitment to the Folio and NXT product lines, as
mentioned in my earlier post.

-Jim
