Doug has just signed the contract to move forward to the TX 4th
district appeals
court. More attorney fees. But we have to do it. We cannot rest

Bob,

Some Clarification! When Commissioned Officers retire they are placed on
the retired list. It doesn't matter whether they have 20 or 30 years. In
the Marine Corps and Navy enlisted are transferred to the "Fleet Reserve"
and formally retire at 30 years. I am not sure about the other services.

I got dirvorced in 2006 in the state of Nebraska, my former spouse was
awarded 28.8 % of my retirement check. I can not make it stop, in
Nebraska the retirement is viewed as Divisible Propety and is not
appealable. I have been to serval attorney's and they all say nothing

To explain - When you retire with more than 20, but less than 30, you draw
"retainer" pay; when you hit 30 in retirement or retire with 30 or more, you
get "retired" pay. Now senior officers (O-7 to O-11) and Senior Enlisted
(E-8 to E-10) can stay up to 40 - ( FORTY ! ) years and draw 100% base pay

Once again to add to the fact that our pay is considered retainer pay
for lesser service. I have hit on this before but just noticed that on
my leave & earnings statement (LES) at the top it reads "years svc:
30. Now I have not served on active duty for 30 years but the Army
lists me at 30 years service. Is apparent that they consider us still

Our thanks to Bob and Karen T. for taking time out of their day to sit
with us in a crowded courthouse and then listen to our "dirty laundry"
getting aired in the courtroom over Doug's MRP.
We lost our Bill of Review but this now opens the door to the
appellate level. Are we devestated? No!
Are we looking forward to finding the money to take it to this level?

First Court Battle Won

Nov 5th was the summary judgment hearing. We won this first round.
Now it is off to the Bill of Review Trial on Nov 16th. We thought
there may be a settlement in between but now it is looking like we
will just go all the way.
Regardless of DFAS stating former spouse percentage based on the
wording in the original DRO is 19.5272% and she currently gets 37%

Now is the time to take action! We need to piggyback our issues onto those of the MAR. We are both seeking the same goal, just by a different route. If all of us write to the media mentioned below and tell our stories, it will add significantly to BOTH efforts - i.e. while adding our voices to the MAR by relating our problems with lifetime alimony and assisting their efforts, we can make use of their extensive publicity network. Remember, small steps lead to big gains. If we can help the MAR win in Massachusetts, that's another "win" for us as well, and can add to the momentum of the nationwide divorce law reform effort. Once state legislators minds are open to reform, our message just get a lot easier to accept.

in San Antonio, TX to get a judge to honor Doug's original DRO vs the
ADRO that was signed against TX Family Code Law that re-divided the
original property division and awarded his former spouse a full 37% on
